{"id":9510,"date":"2026-04-10T16:29:55","date_gmt":"2026-04-10T14:29:55","guid":{"rendered":"https:\/\/guillermou-avocats.fr\/fr\/?p=9510"},"modified":"2026-04-10T16:29:55","modified_gmt":"2026-04-10T14:29:55","slug":"la-lenteur-de-la-justice-prejudiciable-a-lindemnisation-des-victimes","status":"publish","type":"post","link":"https:\/\/guillermou-avocats.fr\/fr\/procedure\/la-lenteur-de-la-justice-prejudiciable-a-lindemnisation-des-victimes","title":{"rendered":"La lenteur de la justice pr\u00e9judiciable \u00e0 l\u2019indemnisation des victimes"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\"  style='background-color: rgba(255,255,255,0);background-position: center center;background-repeat: no-repeat;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;'><div class=\"fusion-builder-row fusion-row \"><div  class=\"fusion-layout-column fusion_builder_column fusion_builder_column_1_1  fusion-one-full fusion-column-first fusion-column-last 1_1\"  style='margin-top:0px;margin-bottom:0px;'>\n\t\t\t\t\t<div class=\"fusion-column-wrapper\" style=\"padding: 0px 0px 0px 0px;background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;\"  data-bg-url=\"\">\n\t\t\t\t\t\t<div class=\"fusion-text\"><p>La question de la c\u00e9l\u00e9rit\u00e9 de la justice, corollaire indispensable du droit \u00e0 un proc\u00e8s \u00e9quitable, se trouve une nouvelle fois au c\u0153ur des pr\u00e9occupations \u00e0 l\u2019occasion d\u2019une affaire r\u00e9cemment \u00e9voqu\u00e9e devant le Tribunal correctionnel de Besan\u00e7on.<\/p>\n<p>La semaine derni\u00e8re, une collaboratrice du cabinet a \u00e9t\u00e9 amen\u00e9e \u00e0 plaider aux fins de voir prononcer la condamnation d\u2019un groupe de la grande distribution, \u00e0 raison des pr\u00e9judices particuli\u00e8rement graves subis par notre client.<\/p>\n<p>\u00c2g\u00e9 de 35 ans au moment des faits, celui-ci a \u00e9t\u00e9 victime d\u2019une chute aux cons\u00e9quences dramatiques, \u00e0 l\u2019origine d\u2019un polytraumatisme majeur. Apr\u00e8s plusieurs semaines pass\u00e9es dans le coma, il conserve aujourd\u2019hui de lourdes s\u00e9quelles, caract\u00e9ris\u00e9es notamment par une parapl\u00e9gie et un traumatisme cr\u00e2nien. L\u2019\u00e9valuation m\u00e9dico-l\u00e9gale de son dommage corporel fait \u00e9tat d\u2019un d\u00e9ficit fonctionnel permanent (DFP) de 68 %.<\/p>\n<p>Or, il aura fallu pas moins de dix ann\u00e9es d\u2019instruction pour que cette affaire soit enfin audienc\u00e9e devant la juridiction r\u00e9pressive. Il \u00e9tait demand\u00e9 au Tribunal de c\u00e9ans de se prononcer sur les responsabilit\u00e9s encourues par les soci\u00e9t\u00e9s poursuivies, condition pr\u00e9alable et d\u00e9terminante \u00e0 l\u2019indemnisation effective des pr\u00e9judices subis.<\/p>\n<p>Toutefois, la situation \u00e9conomique du groupe, actuellement en \u00e9tat de cessation des paiements et engag\u00e9 dans une proc\u00e9dure de liquidation judiciaire avec cessation d\u2019activit\u00e9 annonc\u00e9e en janvier 2027, conf\u00e8re \u00e0 cette affaire un caract\u00e8re d\u2019urgence manifeste. En effet, l\u2019effectivit\u00e9 du droit \u00e0 r\u00e9paration de notre client d\u00e9pend \u00e9troitement de la reconnaissance judiciaire rapide des responsabilit\u00e9s.<\/p>\n<p>En d\u00e9pit de ces \u00e9l\u00e9ments, par d\u00e9cision en date du 1er avril 2026, le Tribunal correctionnel de Besan\u00e7on a ordonn\u00e9 le renvoi de l\u2019affaire au 2 d\u00e9cembre 2026 pour \u00eatre jug\u00e9e au fond. Ce renvoi a pour cons\u00e9quence directe de retarder davantage encore l\u2019issue du proc\u00e8s et, corr\u00e9lativement, de faire obstacle \u00e0 la reprise de l\u2019instance au fond dans le cadre de l\u2019indemnisation, pourtant essentielle \u00e0 la victime.<\/p>\n<p>Une telle situation appelle n\u00e9cessairement une appr\u00e9ciation au regard de l\u2019exigence de c\u00e9l\u00e9rit\u00e9 de la justice. Celle-ci, sans \u00eatre express\u00e9ment consacr\u00e9e en tant que principe autonome, trouve son fondement dans l\u2019article 6 \u00a7 1 de la Convention europ\u00e9enne des droits de l\u2019homme ainsi que dans l\u2019article 14 \u00a7 3 du Pacte international relatif aux droits civils et politiques, lesquels garantissent \u00e0 toute personne le droit \u00e0 ce que sa cause soit entendue dans un d\u00e9lai raisonnable.<\/p>\n<p>La c\u00e9l\u00e9rit\u00e9 proc\u00e9durale constitue ainsi une garantie fondamentale, indissociable de l\u2019effectivit\u00e9 des droits reconnus aux justiciables. Elle rev\u00eat, en mati\u00e8re d\u2019indemnisation du dommage corporel, une importance accrue, d\u00e8s lors que le temps judiciaire est susceptible d\u2019aggraver la situation d\u00e9j\u00e0 pr\u00e9caire des victimes.<\/p>\n<p>En l\u2019esp\u00e8ce, le renvoi de l\u2019audience au fond \u00e0 une date aussi \u00e9loign\u00e9e fait peser une incertitude s\u00e9rieuse sur la possibilit\u00e9 pour notre client d\u2019obtenir, dans un d\u00e9lai utile, la reconnaissance de ses droits et la r\u00e9paration de ses pr\u00e9judices. Cette situation appara\u00eet d\u2019autant plus critiquable que les enjeux humains et financiers sont consid\u00e9rables.<\/p>\n<p>D\u00e8s lors, il convient de s\u2019interroger sur la conciliation, parfois d\u00e9licate, entre les contraintes structurelles de l\u2019institution judiciaire et l\u2019exigence imp\u00e9rieuse de c\u00e9l\u00e9rit\u00e9, laquelle ne saurait demeurer un principe th\u00e9orique, mais doit trouver une traduction concr\u00e8te et effective au b\u00e9n\u00e9fice des justiciables les plus vuln\u00e9rables.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":2,"featured_media":9515,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[93,26,177],"tags":[],"class_list":["post-9510","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-actualites","category-dommage-corporel","category-procedure"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.4 (Yoast SEO v27.3) -
