La canule n\u2019a toutefois \u00e9t\u00e9 retir\u00e9e que quatre jours plus tard, malgr\u00e9 l\u2019apparition d\u2019un syndrome isch\u00e9mique. Il a finalement d\u00fb subir l\u2019amputation d\u2019un membre inf\u00e9rieur.<\/p>\n<p><strong>Que dit la science ?<\/strong><\/p>\n<p>Une \u00e9tude cor\u00e9enne indique que ce risque demeure rare, l\u2019amputation concernant environ 1,6 % des patients.<br \/>\n(https:\/\/perfusion.com\/limb-amputation-following-extracorporeal-membrane-oxygenation-therapy-among-survivors-a-nationwide-cohort-study-from-south-korea\/)<\/p>\n<p>Le Tribunal administratif a \u00e9t\u00e9 saisi par notre cabinet. Deux experts ont \u00e9t\u00e9 missionn\u00e9s : un infectiologue et un chirurgien vasculaire.<\/p>\n<p>L\u2019un des enjeux majeurs de cette expertise \u00e9tait de d\u00e9terminer si l\u2019accident subi par notre client est d\u2019origine fautive ou non.<\/p>\n<p><strong>Bon \u00e0 savoir :<\/strong><\/p>\n<p>L\u2019ECMO constitue aujourd\u2019hui un outil majeur du SAMU pour sauver des vies. Il est d\u00e9sormais possible de mettre en place une circulation extracorporelle directement sur les lieux d\u2019un arr\u00eat cardiaque. Cette technique mobile assure le r\u00f4le de pompe cardiaque et d\u2019oxyg\u00e9nateur pulmonaire.<br \/>\nL\u2019ECMO (<em>Extra Corporeal Membrane Oxygenation<\/em>) \u00e9tait auparavant r\u00e9serv\u00e9e aux blocs chirurgicaux, notamment lors des interventions \u00e0 c\u0153ur ouvert.<\/p>\n<p><strong>Zoom sur les accidents m\u00e9dicaux fautifs \/ accidents m\u00e9dicaux non fautifs<\/strong><\/p>\n<p>La loi Kouchner du 4 mars 2002 distingue les accidents m\u00e9dicaux fautifs des accidents m\u00e9dicaux non fautifs.<\/p>\n<p>Le praticien doit exercer conform\u00e9ment aux r\u00e8gles de l\u2019art et aux donn\u00e9es acquises de la science. Sa responsabilit\u00e9, ou celle de l\u2019\u00e9tablissement de soins, peut \u00eatre engag\u00e9e en cas de faute commise lors d\u2019un acte de diagnostic, de pr\u00e9vention ou de soins, conform\u00e9ment \u00e0 l\u2019article L.1142-1 du Code de la sant\u00e9 publique. Seule une expertise m\u00e9dicale permet d\u2019\u00e9tablir l\u2019existence d\u2019une telle faute.<\/p>\n<p>\u00c0 l\u2019inverse, l\u2019accident m\u00e9dical non fautif, \u00e9galement appel\u00e9 al\u00e9a th\u00e9rapeutique, survient en l\u2019absence de faute. Il s\u2019agit d\u2019\u00e9v\u00e9nements impr\u00e9visibles et in\u00e9vitables. Le patient doit n\u00e9anmoins \u00eatre inform\u00e9 de l\u2019ensemble des risques, m\u00eame tr\u00e8s faibles.<\/p>\n<p>\u00c0 la suite de l\u2019arr\u00eat <em>Bianchi<\/em> (CE, Ass., 9 avril 1993), admettant un r\u00e9gime exceptionnel de responsabilit\u00e9 sans faute pour certains risques th\u00e9rapeutiques, le l\u00e9gislateur est intervenu par la loi du 4 mars 2002. Celle-ci a instaur\u00e9, \u00e0 l\u2019article L.1142-1 du Code de la sant\u00e9 publique, un principe g\u00e9n\u00e9ral de responsabilit\u00e9 pour faute des professionnels de sant\u00e9 et des \u00e9tablissements, sauf notamment en mati\u00e8re d\u2019infections nosocomiales et de d\u00e9fauts de produits de sant\u00e9.<\/p>\n<p>Dans ces hypoth\u00e8ses, ainsi qu\u2019en cas d\u2019accident m\u00e9dical grave non fautif, l\u2019indemnisation des victimes est assur\u00e9e au titre de la solidarit\u00e9 nationale, conform\u00e9ment \u00e0 l\u2019article L.1142-22 du Code de la sant\u00e9 publique.
