Sa famille d\u00e9cide de saisir la CIVI d&rsquo;une demande de r\u00e9paration de leurs pr\u00e9judices.<\/p>\n<p>Dans un premier temps, la Cour d&rsquo;appel de Grenoble d\u00e9clare leur requ\u00eate en indemnisation irrecevable. Les juges estiment que la d\u00e9cision de classement sans suite prise par les autorit\u00e9s vietnamiennes emp\u00eache les demandeurs de former une requ\u00eate devant la commission d&rsquo;indemnisation. En effet le parquet de Sa\u00efgon a consid\u00e9r\u00e9 que l&rsquo;infraction p\u00e9nale n&rsquo;\u00e9tait pas caract\u00e9ris\u00e9e.<\/p>\n<p>La famille de la victime forme alors un pourvoi en cassation. Les juges de la Haute Cour cassent la d\u00e9cision de la Cour d&rsquo;appel de Grenoble en se fondant sur l&rsquo;article 706-3 du Code de Proc\u00e9dure civile. A cet \u00e9gard, ils pr\u00e9cisent que la Cour d&rsquo;appel aurait d\u00fb rechercher le caract\u00e8re mat\u00e9riel de l&rsquo;infraction et ne pas se fonder exclusivement sur le classement sans suite retenu par le Parquet.<\/p>\n<p>Ainsi, les juges du droit rappellent que la saisine de la CIVI ne peut pas \u00eatre rejet\u00e9e pour le seul motif que l&rsquo;enqu\u00eate concernant l&rsquo;infraction a \u00e9t\u00e9 class\u00e9e sans suite.<\/p>\n<p>Cette d\u00e9cision de la Cour de cassation n&rsquo;a rien de surprenant et suit la jurisprudence classique adopt\u00e9e
