{"id":7946,"date":"2021-02-08T10:37:02","date_gmt":"2021-02-08T09:37:02","guid":{"rendered":"https:\/\/guillermou-avocats.fr\/?p=7946"},"modified":"2024-12-27T18:05:51","modified_gmt":"2024-12-27T17:05:51","slug":"nouveautes-pour-lexpertise-medicale-des-victimes-dattentat","status":"publish","type":"post","link":"https:\/\/guillermou-avocats.fr\/fr\/dommage-corporel\/nouveautes-pour-lexpertise-medicale-des-victimes-dattentat","title":{"rendered":"Nouveaut\u00e9s pour l\u2019expertise m\u00e9dicale des victimes d\u2019attentat"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\"  style='background-color: rgba(255,255,255,0);background-position: center center;background-repeat: no-repeat;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;'><div class=\"fusion-builder-row fusion-row \"><div  class=\"fusion-layout-column fusion_builder_column fusion_builder_column_1_1  fusion-one-full fusion-column-first fusion-column-last 1_1\"  style='margin-top:0px;margin-bottom:20px;'>\n\t\t\t\t\t<div class=\"fusion-column-wrapper\" style=\"padding: 0px 0px 0px 0px;background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;\"  data-bg-url=\"\">\n\t\t\t\t\t\t<div class=\"fusion-text\"><h2><em>L\u2019<a href=\"https:\/\/guillermou-avocats.fr\/expertise-medicale\">expertise m\u00e9dicale<\/a> est une \u00e9tape cl\u00e9 dans la r\u00e9paration du pr\u00e9judice corporel. <\/em><\/h2>\n<p>M\u00eame si le rapport d\u2019expertise ne constitue qu\u2019un simple outil pour le juge qui n\u2019est pas tenu par les conclusions du rapport, il lui permet n\u00e9anmoins en pratique de d\u00e9terminer l\u2019\u00e9tendue des <strong><a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">pr\u00e9judices indemnisables<\/a><\/strong>.<\/p>\n<p>En mati\u00e8re d\u2019indemnisation de <a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\"><strong>victime<\/strong><\/a>\u00a0d\u2019actes de terrorisme l\u2019<strong><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006821459\/2004-02-24\">article R. 422-7<\/a><\/strong> du code des assurances pr\u00e9voit un certain nombre de mesures veillant au respect du caract\u00e8re contradictoire de l\u2019examen organis\u00e9 \u00e0 l\u2019initiative du <strong><a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/fonds-de-garantie-des-victimes-des-actes-de-terrorisme-et-dautres-infractionsfgti\">Fonds de Garantie des victimes d\u2019actes de terrorisme et d\u2019autre infractions<\/a><\/strong> (FGTI).<\/p>\n<p>Ainsi, le m\u00e9decin charg\u00e9 d\u2019examiner la victime doit informer celle-ci, 15 jours au moins avant la date d\u2019examen, de son identit\u00e9 et de ses titres, de la date et du lieu de l\u2019examen et de la possibilit\u00e9 de se faire assister d\u2019un m\u00e9decin de son choix.<\/p>\n<p>\u00c0 ce titre, les honoraires du m\u00e9decin de recours de la victime sont pris en charge par le Fonds de Garantie.<\/p>\n<p>Le <strong><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000042574326\">d\u00e9cret du 27 novembre 2020<\/a><\/strong> vient renforcer ces mesures (article 7).<\/p>\n<p>Depuis le 29 novembre (date d\u2019entr\u00e9e en vigueur du d\u00e9cret) il incombe au m\u00e9decin d\u00e9sign\u00e9 par le FGTI, d\u2019envoyer un pr\u00e9-rapport aux parties \u00e0 l\u2019issue de l\u2019expertise, celles-ci disposant ensuite de 30 jours pour formuler leurs observations \u00e9crites.<\/p>\n<h3>Le rapport d\u00e9finitif de l\u2019expert d\u00e9sign\u00e9 par le FGTI, qui mentionne les suites donn\u00e9es \u00e0 ces observations, est ensuite envoy\u00e9 dans les 20 jours de la r\u00e9ception des derni\u00e8res observations.<\/h3>\n<p>En cas de non-<strong><a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-131-consolidation\">consolidation<\/a><\/strong>, le rapport se prononce sur l\u2019\u00e9tat de sant\u00e9 de la victime, ses perspectives d\u2019\u00e9volution et lui propose une nouvelle date d\u2019examen.<\/p>\n<p><strong>Attention\u00a0: si depuis le 1<sup>er<\/sup> septembre 2020, il incombe au FGTI de d\u00e9signer un expert judiciaire en lieu et place des m\u00e9decins conseil habituellement d\u00e9sign\u00e9s, l\u2019expertise organis\u00e9e n\u2019en devient pas pour autant judiciaire. Elle ne reste qu\u2019une simple expertise amiable contradictoire.
