{"id":7760,"date":"2020-11-09T11:02:36","date_gmt":"2020-11-09T10:02:36","guid":{"rendered":"https:\/\/guillermou-avocats.fr\/?p=7760"},"modified":"2024-09-12T09:52:38","modified_gmt":"2024-09-12T07:52:38","slug":"prejudice-dagrement-indemnisation-des-frais-de-handisport","status":"publish","type":"post","link":"https:\/\/guillermou-avocats.fr\/fr\/jurisprudences\/prejudice-dagrement-indemnisation-des-frais-de-handisport","title":{"rendered":"Pr\u00e9judice d&rsquo;agr\u00e9ment : indemnisation des frais de handisport"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\"  style='background-color: rgba(255,255,255,0);background-position: center center;background-repeat: no-repeat;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;'><div class=\"fusion-builder-row fusion-row \"><div  class=\"fusion-layout-column fusion_builder_column fusion_builder_column_1_1  fusion-one-full fusion-column-first fusion-column-last 1_1\"  style='margin-top:0px;margin-bottom:20px;'>\n\t\t\t\t\t<div class=\"fusion-column-wrapper\" style=\"padding: 0px 0px 0px 0px;background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;\"  data-bg-url=\"\">\n\t\t\t\t\t\t<div class=\"fusion-text\"><h2>L\u2019indemnisation des frais li\u00e9 \u00e0 la pratique d\u2019un handisport est-elle compatible avec celle d\u2019un pr\u00e9judice d\u2019agr\u00e9ment ?<\/h2>\n<p>Un motard a \u00e9t\u00e9 victime d\u2019un <a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\/id-1-accident-route-indemnisation\">accident de la circulation<\/a> dans lequel a \u00e9t\u00e9 impliqu\u00e9 un autre v\u00e9hicule dont ni le conducteur ni le v\u00e9hicule n\u2019ont pu \u00eatre identifi\u00e9s.<\/p>\n<p>Le <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/fonds-de-garantie-des-assurances-obligatoires-de-dommage-fgao\">Fonds de Garantie des Assurances Obligatoires de Dommages<\/a> (FGAO) est alors actionn\u00e9 pour ouvrir droit \u00e0 une <a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">r\u00e9paration des pr\u00e9judices<\/a> de la victime.<\/p>\n<p>Face au refus du Fonds de Garantie d\u2019indemniser notamment le <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-123-prejudice-d-agrement\">pr\u00e9judice d\u2019agr\u00e9ment<\/a>, l\u2019affaire est port\u00e9e jusqu\u2019\u00e0 la Cour d\u2019Appel de Paris.<\/p>\n<p>D\u00e9sormais <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-112-paraplegie\">parapl\u00e9gique<\/a>, ce jeune homme est pourtant dans l\u2019incapacit\u00e9 de continuer \u00e0 pratiquer le football, le footing et la boxe tha\u00ef.<\/p>\n<p>Afin de conserver une activit\u00e9 physique, cette <a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\">victime<\/a> s\u2019est tourn\u00e9e vers la pratique de plusieurs handisports \u00e0 savoir le handi-basket et handi-bike.<\/p>\n<p>Il sollicite donc, en sus de la r\u00e9paration de son pr\u00e9judice d\u2019agr\u00e9ment, l\u2019indemnisation des frais li\u00e9s \u00e0 la pratique de cette nouvelle activit\u00e9.<\/p>\n<p>Le Fonds de Garantie rejette les deux demandes au motif que\u00a0:<\/p>\n<ul>\n<li>D\u2019une part, la victime n\u2019apporte aucune pi\u00e8ce justificative des pratiques sportives all\u00e9gu\u00e9es.<\/li>\n<li>D\u2019autre part, la demande de prise en charge du mat\u00e9riel d\u2019handisport ne rel\u00e8ve d\u2019aucune prescription m\u00e9dicale.<\/li>\n<\/ul>\n<h3>L\u2019indemnisation du co\u00fbt du mat\u00e9riel handisport et de son renouvellement n\u2019est pas incompatible avec l\u2019indemnisation d\u2019un pr\u00e9judice d\u2019agr\u00e9ment.<\/h3>\n<p>Le FGAO est doublement sanctionn\u00e9 par la Cour d\u2019Appel de Paris qui\u00a0le condamne \u00e0:<\/p>\n<ul>\n<li>Indemniser le <strong>co\u00fbt du mat\u00e9riel sp\u00e9cifique<\/strong> n\u00e9cessaire \u00e0 la pratique de ses activit\u00e9s sportives nouvelles et son renouvellement<\/li>\n<li>Indemniser un<strong> pr\u00e9judice d\u2019agr\u00e9ment \u00e0 hauteur de 30\u00a0000 \u20ac<\/strong> <strong>m\u00eame en l\u2019absence de justificatif<\/strong>, le temp\u00e9rament sportif de la victime \u00e9tant induit par l\u2019initiation \u00e0 plusieurs activit\u00e9s de handisport.<\/li>\n<\/ul>\n<p>Ainsi deux principes importants sont d\u00e9gag\u00e9s par la Cour d\u2019Appel de Paris\u00a0:<\/p>\n<p><em>La <strong>preuve<\/strong> de la pratique des activit\u00e9s d\u2019agr\u00e9ment peut \u00eatre <a href=\"https:\/\/guillermou-avocats.fr\/dommage-corporel\/indemnisation-du-prejudice-dagrement-validite-des-attestations-prouvant-la-pratique-de-football-lors-de-rencontres-amiables\"><strong>apport\u00e9e par tout moyen<\/strong><\/a>. En l\u2019esp\u00e8ce, la Cour d\u2019Appel a fait usage de son <strong>pouvoir souverain d\u2019appr\u00e9ciation<\/strong> pour d\u00e9duire que la victime avait n\u00e9cessairement un temp\u00e9rament sportif pr\u00e9existant. <\/em><\/p>\n<p>Voici une belle application du <strong>principe de la r\u00e9paration int\u00e9grale<\/strong> qui, rappelons-le, vise \u00e0 \u00ab\u00a0<em>r\u00e9tablir aussi exactement que possible l&rsquo;\u00e9quilibre d\u00e9truit par le dommage de replacer la victime dans la situation o\u00f9 elle se serait trouv\u00e9e si l&rsquo;acte dommageable n&rsquo;avait pas eu lieu \u00bb<\/em> (jurisprudence constante de la cour de cassation depuis 1954).<\/p>\n<p>Source\u00a0:<a href=\"https:\/\/www.doctrine.fr\/d\/CA\/Paris\/2019\/C6B4EABAC8F6DE6DE5E40\"> CA Paris, 2-3, 7 janv. 2019, n\u00b0 16\/17494<\/a><\/p>\n<blockquote class=\"td_quote_box td_box_left\">\n<p>Victime d\u2019un dommage corporel\u00a0?
