Il est condamn\u00e9 \u00e0 r\u00e9parer les cons\u00e9quences dommageables de cet accident solidairement avec son assureur. Une<a href=\"https:\/\/guillermou-avocats.fr\/expertise-medicale\"> expertise m\u00e9dicale<\/a> est ordonn\u00e9e.<\/p>\n<p style=\"text-align: justify;\">Le jugement alloue \u00e0 la <a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\">victime<\/a> une indemnisation de la <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-190-perte-de-gains-professionnels-actuels-pgpa\">perte de gains professionnels actuels<\/a>. \u00a0Mais en appel, il est infirm\u00e9 et les montants des charges sociales et fiscales sont d\u00e9duits de l\u2019indemnit\u00e9. La cour d\u2019appel avait relev\u00e9 que la victime avait repris son activit\u00e9 professionnelle au sein de la soci\u00e9t\u00e9 en nom collectif dont elle d\u00e9tenait 50 % du capital mais \u00e9tait rest\u00e9e\u00a0 cantonn\u00e9e \u00e0 la partie administrative alors qu\u2019avant l\u2019accident elle assurait \u00a0principalement des travaux m\u00e9caniques&#8230;<\/p>\n<p style=\"text-align: justify;\">La victime se pourvoit en cassation pour faire valoir son droit \u00e0 r\u00e9paration du pr\u00e9judice.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Le surco\u00fbt engendr\u00e9 par l\u2019embauche d\u2019un rempla\u00e7ant inclut les charges sociales et fiscales<\/strong><\/h3>\n<p style=\"text-align: justify;\">Par arr\u00eat du <a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000042088524?tab_selection=all&amp;searchField=ALL&amp;query=19-18263&amp;page=1&amp;init=true\">25 juin 2020 num\u00e9ro 19 \u2013 18. 263<\/a> la juridiction casse cette d\u00e9cision :<\/p>\n<p style=\"text-align: justify;\"><em>\u00abVu le principe de la <a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">r\u00e9paration int\u00e9grale<\/a> sans perte ni profit pour la <a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\">victime<\/a> :<\/em><\/p>\n<p style=\"text-align: justify;\"><em>8. Pour fixer le pr\u00e9judice avant <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-132-aggravation-2\">aggravation<\/a> au montant de 58 506 euros pour la <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-190-perte-de-gains-professionnels-actuels-pgpa\">perte de gains professionnels actuels<\/a>, l&rsquo;arr\u00eat, apr\u00e8s avoir relev\u00e9 que M. W&#8230; avait repris son activit\u00e9 professionnelle au sein de la soci\u00e9t\u00e9 en nom collectif dont il d\u00e9tenait 50 % du capital, mais cantonn\u00e9e \u00e0 la partie administrative alors qu&rsquo;avant l&rsquo;<a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\/id-1-accident-route-indemnisation\">accident<\/a> il assurait principalement les travaux de m\u00e9canique, \u00e9nonce qu&rsquo;il convient de retenir la somme de<strong> 58 506 euros<\/strong> correspondant \u00e0 la perte de revenus li\u00e9e \u00e0 l&#8217;embauche d&rsquo;un m\u00e9canicien pour remplacer la victime, <strong>apr\u00e8s d\u00e9duction des charges sociales et fiscales.<\/strong><\/em><\/p>\n<p style=\"text-align: justify;\"><em><strong>9. En statuant ainsi, alors qu&rsquo;il r\u00e9sultait de ses constatations que ces charges, assum\u00e9es pour pourvoir au remplacement de la victime, \u00e9taient en lien direct avec l&rsquo;accident, la cour d&rsquo;appel a viol\u00e9 le principe susvis\u00e9.<\/strong><\/em><\/p>\n<p style=\"text-align: justify;\"><em>Port\u00e9e et cons\u00e9quences de la cassation<\/em><\/p>\n<p style=\"text-align: justify;\"><em>10. En application de l&rsquo;article 624 du code de proc\u00e9dure civile, la cassation des dispositions de l&rsquo;arr\u00eat attaqu\u00e9 fixant \u00e0 la somme de 58 506 euros la perte de gains professionnels actuels entra\u00eene, par voie de cons\u00e9quence, celle des dispositions fixant les pr\u00e9judices avant aggravation de M. W&#8230; au <strong>montant total de 158 466, 05 euros<\/strong> et condamnant solidairement M. H&#8230; et la caisse r\u00e9gionale d&rsquo;assurances mutuelles agricoles Bretagne Pays de Loire, dite Groupama Loire Bretagne, \u00e0 payer \u00e0 M. W&#8230; la somme de <strong>167 726,90 euros<\/strong> ainsi que des dispositions relatives au recours de la caisse locale d\u00e9l\u00e9gu\u00e9e pour la s\u00e9curit\u00e9 sociale des travailleurs ind\u00e9pendants de Bretagne en sa qualit\u00e9 de tiers payeur, qui s&rsquo;y rattachent par un lien de d\u00e9pendance n\u00e9cessaire.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>PAR CES MOTIFS, et sans qu&rsquo;il y ait lieu de statuer sur les autres griefs du pourvoi, la Cour :<\/em><\/p>\n<p style=\"text-align: justify;\"><em>CASSE ET ANNULE (\u2026)\u00a0\u00bb<\/em><\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":2,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[33,26,25,128,34,115],"tags":[],"class_list":["post-7650","post","type-post","status-publish","format-standard","hentry","category-accident-de-la-circulation","category-dommage-corporel","category-jurisprudences","category-perte-de-gains-professionnels","category-responsabilite","category-victime"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.4 (Yoast SEO v27.4) -
