{"id":7322,"date":"2020-06-17T18:26:12","date_gmt":"2020-06-17T16:26:12","guid":{"rendered":"https:\/\/guillermou-avocats.fr\/?p=7322"},"modified":"2024-09-12T10:45:26","modified_gmt":"2024-09-12T08:45:26","slug":"licenciement-du-salarie-en-raison-de-la-discrimination-liee-a-son-etat-de-sante-et-son-handicap","status":"publish","type":"post","link":"https:\/\/guillermou-avocats.fr\/fr\/jurisprudences\/licenciement-du-salarie-en-raison-de-la-discrimination-liee-a-son-etat-de-sante-et-son-handicap","title":{"rendered":"Licenciement du salari\u00e9 en raison de la discrimination li\u00e9e \u00e0 son \u00e9tat de sant\u00e9 et son handicap"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\"  style='background-color: rgba(255,255,255,0);background-position: center center;background-repeat: no-repeat;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;'><div class=\"fusion-builder-row fusion-row \"><div  class=\"fusion-layout-column fusion_builder_column fusion_builder_column_1_1  fusion-one-full fusion-column-first fusion-column-last 1_1\"  style='margin-top:0px;margin-bottom:0px;'>\n\t\t\t\t\t<div class=\"fusion-column-wrapper\" style=\"padding: 0px 0px 0px 0px;background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;\"  data-bg-url=\"\">\n\t\t\t\t\t\t<div class=\"fusion-text\"><h2 style=\"text-align: justify;\">Le licenciement constitutif d\u2019une discrimination li\u00e9e au handicap est\u00a0nul<\/h2>\n<p style=\"text-align: justify;\">Une personne\u00a0 est engag\u00e9e le 28 avril 1998 par une soci\u00e9t\u00e9 en qualit\u00e9 d&rsquo;agent d\u2019entretien.<\/p>\n<p style=\"text-align: justify;\">Le 15 juin 2010, elle est plac\u00e9e en arr\u00eat de travail suite \u00e0 un <strong><a href=\"https:\/\/guillermou-avocats.fr\/id-6-accident-travail-indemnisation\">accident<\/a> <\/strong>dont le caract\u00e8re professionnel est ult\u00e9rieurement reconnu par la caisse primaire d&rsquo;assurance maladie.<\/p>\n<p style=\"text-align: justify;\">Le 24 d\u00e9cembre 2010, elle est reconnue <a href=\"https:\/\/blog.guillermou-avocats.fr\/articles\/simplification-de-la-procedure-de-reconnaissance-de-la-qualite-de-travailleur-handicape\">travailleur handicap\u00e9<\/a>. Or, apr\u00e8s avoir \u00e9t\u00e9 d\u00e9clar\u00e9 inapte le 7 avril 2015, elle est licenci\u00e9e pour inaptitude et impossibilit\u00e9 de reclassement.<\/p>\n<p style=\"text-align: justify;\">En appel, la cour constate que l&#8217;employeur n&rsquo;a pas respect\u00e9 son obligation de reclassement du salari\u00e9 en situation de handicap. Elle d\u00e9cide que le licenciement du salari\u00e9 est annul\u00e9 en raison de <strong>la discrimination li\u00e9e \u00e0 son \u00e9tat de sant\u00e9 et son <a href=\"https:\/\/guillermou-avocats.fr\/dommage-corporel\/le-handicap-moteur\">handicap<\/a><\/strong> et, en cons\u00e9quence, l\u2019employeur est\u00a0 condamn\u00e9 \u00e0 lui verser diverses sommes \u00e0 titre d&rsquo;<strong>indemnit\u00e9<\/strong> de pr\u00e9avis et cong\u00e9s pay\u00e9s aff\u00e9rents et de dommages-int\u00e9r\u00eats.<\/p>\n<p style=\"text-align: justify;\">L\u2019employeur se pourvoit en cassation. Il soutient notamment, pour contester\u00a0la nullit\u00e9 du licenciement, que l&rsquo;obligation de reclassement a pour seule cons\u00e9quence de priver le licenciement de cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<h3>Manquement de l&#8217;employeur \u00e0 son obligation de reclassement<\/h3>\n<p style=\"text-align: justify;\">Par arr\u00eat du <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000041995790&amp;fastReqId=1704694091&amp;fastPos=1\">\u00a03 juin 2020 n\u00b018-21993\u00a0 ,\u00a0<\/a>la Haute juridiction rejette le pourvoi\u00a0:<\/p>\n<p style=\"text-align: justify;\"><em>\u00ab\u00a0Mais attendu, d&rsquo;abord, que la cour d&rsquo;appel a estim\u00e9, par une appr\u00e9ciation souveraine des \u00e9l\u00e9ments de preuve qui lui \u00e9taient soumis, hors toute d\u00e9naturation, que l&#8217;employeur n&rsquo;avait pas ex\u00e9cut\u00e9 s\u00e9rieusement et loyalement son obligation de reclassement ;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Attendu, ensuite, que si le manquement de l&#8217;employeur \u00e0 son obligation de reclassement a pour cons\u00e9quence de priver de cause r\u00e9elle et s\u00e9rieuse le licenciement prononc\u00e9 pour inaptitude et impossibilit\u00e9 de reclassement, l&rsquo;article L. 5213-6 du code du travail dispose qu&rsquo;afin de garantir le respect du principe d&rsquo;\u00e9galit\u00e9 de traitement \u00e0 l&rsquo;\u00e9gard des travailleurs handicap\u00e9s, l&#8217;employeur prend, en fonction des besoins dans une situation concr\u00e8te, les mesures appropri\u00e9es pour leur permettre d&rsquo;acc\u00e9der \u00e0 un emploi ou de conserver un emploi correspondant \u00e0 leur qualification, de l&rsquo;exercer ou d&rsquo;y progresser ou pour qu&rsquo;une formation adapt\u00e9e \u00e0 leurs besoins leur soit dispens\u00e9e, que ces mesures sont prises sous r\u00e9serve que les charges cons\u00e9cutives \u00e0 leur mise en \u0153uvre ne soient pas disproportionn\u00e9es, compte tenu de l&rsquo;aide pr\u00e9vue \u00e0 l&rsquo;article L. 5213-10 qui peut compenser en tout ou partie les d\u00e9penses support\u00e9es \u00e0 ce titre par l&#8217;employeur, et que le refus de prendre ces mesures peut \u00eatre constitutif d&rsquo;une discrimination au sens de l&rsquo;article L. 1133-3 ;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Et attendu que la cour d&rsquo;appel, qui a constat\u00e9 que<strong> l&#8217;employeur, nonobstant l&rsquo;importance de ses effectifs et le nombre de ses m\u00e9tiers, ne justifiait pas d&rsquo;\u00e9tudes de postes ni de recherche d&rsquo;am\u00e9nagements du poste du salari\u00e9, et qu&rsquo;il n&rsquo;avait pas consult\u00e9 le Service d&rsquo;appui au maintien dans l&#8217;emploi des travailleurs handicap\u00e9s (SAMETH), bien qu&rsquo;il y ait \u00e9t\u00e9 invit\u00e9 \u00e0 deux reprises par le salari\u00e9, a pu en d\u00e9duire qu&rsquo;il avait refus\u00e9 de prendre les mesures appropri\u00e9es pour permettre \u00e0 ce dernier de conserver un emploi, ce dont il r\u00e9sultait que le licenciement constitutif d&rsquo;une discrimination \u00e0 raison d&rsquo;un <a href=\"https:\/\/guillermou-avocats.fr\/dommage-corporel\/le-handicap-moteur\">handicap<\/a> \u00e9tait nul ;<\/strong><\/em><\/p>\n<p style=\"text-align: justify;\"><em>D&rsquo;o\u00f9 il suit que le moyen n&rsquo;est pas fond\u00e9 ;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>PAR CES MOTIFS, la Cour :<\/em><\/p>\n<p style=\"text-align: justify;\"><em>REJETTE le pourvoi \u00a0\u00bb<\/em><\/p>\n<p style=\"text-align: justify;\">Source: L\u00e9gifrance<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":2,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[84,26,39,25,115],"tags":[],"class_list":["post-7322","post","type-post","status-publish","format-standard","hentry","category-accident-du-travail","category-dommage-corporel","category-handicap","category-jurisprudences","category-victime"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.4 (Yoast SEO v27.4) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>Les droits des salari\u00e9s handicap\u00e9s: Licenciement et discrimination - Avocat indemnisation de victimes<\/title>\n<meta name=\"description\" content=\"D\u00e9couvrez les cons\u00e9quences d&#039;un licenciement discriminatoire li\u00e9 \u00e0 l&#039;\u00e9tat de sant\u00e9 et au handicap d&#039;un salari\u00e9.
