Elle doit \u00eatre op\u00e9r\u00e9e \u00e0 l\u2019h\u00f4pital pour r\u00e9aliser l\u2019ablation d\u2019un cavernome le 20 f\u00e9vrier 2007. Mais elle contracte un staphylocoque dor\u00e9 et son op\u00e9ration est repouss\u00e9e au 28 f\u00e9vrier 2007. La patiente s\u2019estime <a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\">victime<\/a> d\u2019une <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/infection-nosocomiale\">infection nosocomiale<\/a> qui a diminu\u00e9 \u00a0les chances de succ\u00e8s de l\u2019op\u00e9ration chirurgicale et qui est \u00e0 l\u2019origine des s\u00e9quelles dont elle demeure atteinte. Elle saisit une <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-154-commission-de-conciliation-et-d-indemnisation-cci\">commission r\u00e9gionale de conciliation et d\u2019indemnisation<\/a> qui \u00e9met un avis favorable \u00e0 son <a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">indemnisation au titre de la solidarit\u00e9 nationale<\/a>. L\u2019<a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-109-office-national-d-indemnisation-des-accidents-medicaux-des-affections-iatrogenes-et-des-infections-nosocomiales-oniam\">ONIAM<\/a> refuse toutefois d\u2019adresser \u00a0une offre d\u2019indemnisation \u00e0 la victime.<\/p>\n<p style=\"text-align: justify;\">En 2016 le tribunal administratifs condamne l\u2019<a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-109-office-national-d-indemnisation-des-accidents-medicaux-des-affections-iatrogenes-et-des-infections-nosocomiales-oniam\">ONIAM<\/a> \u00e0 verser la somme de 189\u00a0660,85 \u20ac ainsi qu\u2019une rente de 19,5 \u20ac par jour. L\u2019ONIAM et la victime interjettent appel.<\/p>\n<p style=\"text-align: justify;\">Le 31 mai 2018, la cour administrative d\u2019appel porte la somme \u00e0 201\u00a0638 \u20ac et la rente \u00e0 23,70 \u20ac par jour. L\u2019ONIAM se pourvoit en cassation.<\/p>\n<h3 style=\"text-align: justify;\">Indemnisation d&rsquo;une perte de chance<\/h3>\n<p style=\"text-align: justify;\">Le Conseil d\u2019\u00c9tat par <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriAdmin.do?oldAction=rechJuriAdmin&amp;idTexte=CETATEXT000041569403&amp;fastReqId=1651405024&amp;fastPos=1\">arr\u00eat du 12 f\u00e9vrier 2000 n\u00b0 422754<\/a> rejette le pourvoi de l\u2019ONIAM.<\/p>\n<p style=\"text-align: justify;\">Il confirme que l\u2019infection nosocomiale a fait perdre \u00e0 l\u2019int\u00e9ress\u00e9e une chance d\u2019am\u00e9lioration de son \u00e9tat de sant\u00e9 et pr\u00e9cise comment le taux d\u2019incapacit\u00e9 qui ouvre droit (aupr\u00e8s de l\u2019ONIAM) \u00e0 une indemnisation pour perte de chance, est calcul\u00e9.<\/p>\n<p style=\"text-align: justify;\"><em>\u00ab\u00a0Pour l\u2019application des dispositions de l\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072665&amp;idArticle=LEGIARTI000006685994&amp;dateTexte=&amp;categorieLien=cid\">article L 1142 \u2013 1 \u2013 1 du code de la sant\u00e9 publique<\/a> dans l\u2019hypoth\u00e8se o\u00f9 une infection nosocomiale est \u00e0 l\u2019origine d\u2019un<a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-127-prejudice-corporel\"> pr\u00e9judice<\/a> constitu\u00e9 d\u2019une perte de chance, <strong>le pr\u00e9judice est indemnis\u00e9 au titre de la solidarit\u00e9 nationale lorsque le taux d\u2019atteinte permanente \u00e0 l\u2019int\u00e9grit\u00e9 du patient, calcul\u00e9 par la diff\u00e9rence entre, d\u2019une part, la capacit\u00e9 que l\u2019int\u00e9ress\u00e9 aurait eu une tr\u00e8s grande probabilit\u00e9 de r\u00e9cup\u00e9rer gr\u00e2ce \u00e0 l\u2019intervention en l\u2019absence de cette infection et, d\u2019autre part, la capacit\u00e9 constat\u00e9e apr\u00e8s <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-131-consolidation\">consolidation<\/a> du pr\u00e9judice r\u00e9sultant de l\u2019infection, est sup\u00e9rieur \u00e0 25 %.<\/strong> \u00bb<\/em>.<\/p>\n<p style=\"text-align: justify;\"><em>Le Conseil d\u2019\u00c9tat retient que:<\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u00ab\u00a0pour d\u00e9terminer le taux d\u2019incapacit\u00e9 permanente dont la victime reste atteinte, la cour a retenu que l\u2019acte chirurgical qui \u00e9tait pr\u00e9vu avait une tr\u00e8s grande probabilit\u00e9, compte tenu du jeune \u00e2ge de la patiente, de permettre sa gu\u00e9rison quasi-totale.
