Cet acte est r\u00e9alis\u00e9 dans le cadre de l\u2019activit\u00e9 priv\u00e9e du m\u00e9decin. Suite \u00e0 l\u2019intervention, l\u2019homme se plaint de <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/paresthesie\">paresth\u00e9sies<\/a> du bras droit. Un examen de contr\u00f4le le 22 f\u00e9vrier 2013, r\u00e9v\u00e8le la pr\u00e9sence de six corps \u00e9trangers m\u00e9talliques au niveau des art\u00e8res hum\u00e9rales et sous-clavi\u00e8res .<\/p>\n<p style=\"text-align: justify;\">L&rsquo;homme, qui s\u2019estime\u00a0<a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\">victime<\/a>\u00a0d\u2019un <a href=\"https:\/\/guillermou-avocats.fr\/id-5-accident-medicaux-indemnisation\">accident m\u00e9dical<\/a>, assigne le m\u00e9decin en <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-119-refere\">r\u00e9f\u00e9r\u00e9<\/a>\u00a0 afin d&rsquo;obtenir une <a href=\"https:\/\/guillermou-avocats.fr\/expertise-medicale\">expertise m\u00e9dicale<\/a>\u00a0. Le Tribunal de Grande Instance acc\u00e8de \u00e0 sa demande. Le rapport conclut <em>\u00ab \u00e0 la persistance de corps \u00e9tranger intra art\u00e9riel identifi\u00e9 comme des parties d\u2019un guide ayant migr\u00e9 dans la circulation art\u00e9rielle du fait d\u2019une erreur d\u2019inattention du docteur \u00bb<\/em><\/p>\n<p style=\"text-align: justify;\">La victime assigne au fond le m\u00e9decin et sa compagnie d\u2019assurances en vue d\u2019obtenir l\u2019<a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\"><strong>indemnisation de son pr\u00e9judice<\/strong><\/a>.<\/p>\n<h3 style=\"text-align: justify;\">Un <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-212-prejudices-permanents-exceptionnels\">pr\u00e9judice exceptionnel<\/a> indemnis\u00e9 \u00e0 hauteur de 20\u00a0000 \u20ac<\/h3>\n<p style=\"text-align: justify;\">Par arr\u00eat du 23 mai 2019 num\u00e9ro 18\/00 220, la cour d\u2019appel de Chamb\u00e9ry confirme l\u2019existence d\u2019un pr\u00e9judice exceptionnel :<\/p>\n<p style=\"text-align: justify;\"><em>\u00abSur l&rsquo;indemnisation au titre d&rsquo;un pr\u00e9judice exceptionnel<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Si une demande d&rsquo;indemnisation peut \u00eatre formul\u00e9e au titre du pr\u00e9judice exceptionnel, il importe que le demandeur justifie d&rsquo;un trouble distinct de celui indemnis\u00e9 au titre des autres postes, notamment au titre des\u00a0<\/em><a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/souffrances-endurees-pretium-doloris\"><em>souffrances endur\u00e9es<\/em><\/a><em>, lesquelles ont vocation \u00e0 prendre en compte l&rsquo;ensemble des douleurs psychiques \u00e9prouv\u00e9es, ou du <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-58-deficit-fonctionnel-permanent-dfp\">d\u00e9ficit fonctionnel permanent<\/a> lequel indemnise la r\u00e9duction d\u00e9finitive du potentiel physique, psycho-sensoriel et intellectuel.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong><em>En l&rsquo;esp\u00e8ce, l&rsquo;expert identifie l&rsquo;existence d&rsquo;un pr\u00e9judice exceptionnel en raison de la pr\u00e9sence de fragments de guide dans le corps de la victime et du risque d&rsquo;\u00e9volution permanent de son \u00e9tat de sant\u00e9. Pour l&rsquo;expert, ces \u00e9l\u00e9ments provoquent une angoisse chez Monsieur L. laquelle a \u00e9t\u00e9 renforc\u00e9e \u00e0 deux reprises lors de thrombose de l&rsquo;art\u00e8re hum\u00e9rale et la dissection de la carotide primitive droite.<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><em>Monsieur L. objective pour sa part cette angoisse par des consultations fr\u00e9quentes au centre m\u00e9dico-psychologique d&rsquo;Albertville (pi\u00e8ces n\u00b092 \u00e0 94 &#8211; SCP C.
