Le conducteur de la camionnette est d\u00e9clar\u00e9 coupable de blessures involontaires est enti\u00e8rement responsable du<a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-127-prejudice-corporel\"> pr\u00e9judice<\/a> subi par la <a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\">victime<\/a>.<\/p>\n<p style=\"text-align: justify;\">En premi\u00e8re instance, une <a href=\"https:\/\/guillermou-avocats.fr\/expertise-medicale\">expertise m\u00e9dicale<\/a> est ordonn\u00e9e. Le responsable de l\u2019accident est ensuite condamn\u00e9 \u00e0 verser certaines sommes \u00e0 la victime au titre de <strong><a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">r\u00e9paration du pr\u00e9judice corporel<\/a><\/strong>.<\/p>\n<p style=\"text-align: justify;\">En appel, la cour rejette la demande d\u2019indemnisation du poste d\u2019<a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-83-incidence-professionnelle-ip\">incidence professionnelle<\/a>. L\u2019arr\u00eat retient que celle-ci a pour objet d\u2019indemniser les difficult\u00e9s de reclassement professionnel et suppose la possibilit\u00e9 de poursuite d\u2019une profession et qu\u2019en \u00a0l\u2019esp\u00e8ce, comme il a \u00e9t\u00e9 retenu que la victime n\u2019\u00e9tait plus en capacit\u00e9 de poursuivre une activit\u00e9 professionnelle, l\u2019indemnisation titre de la perte de gains professionnels futurs avait d\u00e9j\u00e0 pour objet d\u2019indemniser ce chef de pr\u00e9judice.<\/p>\n<h3 style=\"text-align: justify;\">Indemnisation de l\u2019incidence professionnelle<\/h3>\n<p style=\"text-align: justify;\">Par arr\u00eat du <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000038629386&amp;fastReqId=1268789358&amp;fastPos=1\">28 mai 2019 <\/a>, la chambre criminelle de la Cour de cassation casse ce moyen du pourvoi :<\/p>\n<p style=\"text-align: justify;\"><em>\u00ab<strong>Mais attendu qu\u2019en se d\u00e9terminant ainsi alors que M.
