g\u00e9n\u00e9rale, sans surveillance par un personnel habilit\u00e9 commet une faute caract\u00e9ris\u00e9e et expose la victime \u00e0 un risque d\u2019une particuli\u00e8re gravit\u00e9\u2026<\/em><\/p>\n<h2>Responsabilit\u00e9 m\u00e9dicale<\/h2>\n<p style=\"text-align: justify;\">Le 12 d\u00e9cembre 2007, une jeune femme de 23 ans, est hospitalis\u00e9e en clinique pour y subir deux interventions courantes: une biopsie ut\u00e9rine par curetage puis une c\u0153lioscopie, destin\u00e9es \u00e0 poser un diagnostic sur des douleurs pelviennes.<\/p>\n<p style=\"text-align: justify;\">Apr\u00e8s la 1\u00e8re op\u00e9ration, la jeune femme est victime d\u2019une <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-175-cerebro-lese\">anoxie<\/a> prolong\u00e9e apr\u00e8s d\u00e9connexion de la sonde endotrach\u00e9ale.<\/p>\n<p style=\"text-align: justify;\">L\u2019anesth\u00e9siste \u00a0s\u2019\u00e9tait absent\u00e9e \u00a0de la salle de soins pour se rendre au chevet d\u2019un autre patient laissant la <a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\">victime<\/a> en pr\u00e9sence d\u2019une \u00a0infirmi\u00e8re de bloc op\u00e9ratoire rest\u00e9e sur place pour pr\u00e9parer le mat\u00e9riel.<\/p>\n<p style=\"text-align: justify;\">Une <a href=\"https:\/\/guillermou-avocats.fr\/expertise-medicale\">expertise m\u00e9dicale<\/a> conclut \u00e0 une incapacit\u00e9 permanente partielle de 99 % de la victime.<\/p>\n<p style=\"text-align: justify;\">Le m\u00e9decin anesth\u00e9siste est renvoy\u00e9 devant le tribunal correctionnel du chef de blessures involontaires pour avoir laiss\u00e9 sans surveillance une patiente plac\u00e9e sous anesth\u00e9sie g\u00e9n\u00e9rale, lesdites blessures ayant entra\u00een\u00e9 une incapacit\u00e9 de travail de plus de trois mois.<\/p>\n<p style=\"text-align: justify;\">Mais le tribunal correctionnel relaxe l\u2019anesth\u00e9siste des fins de la poursuite.<\/p>\n<p style=\"text-align: justify;\">Les parties civiles et le Procureur de la R\u00e9publique interjettent alors \u00a0appel de cette d\u00e9cision.<\/p>\n<p style=\"text-align: justify;\">Le 25 septembre 2017, la \u00a0Cour d\u2019appel condamne l\u2019anesth\u00e9siste \u00e0 6 mois d\u2019emprisonnement avec sursis pour blessures involontaires et se prononce sur les int\u00e9r\u00eats civils.<\/p>\n<p style=\"text-align: justify;\">Le m\u00e9decin anesth\u00e9siste se pourvoit en cassation.<\/p>\n<h3 style=\"text-align: justify;\">La faute du m\u00e9decin anesth\u00e9siste caract\u00e9ris\u00e9e<\/h3>\n<p style=\"text-align: justify;\">Par arr\u00eat du <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000038060557&amp;fastReqId=1381661717&amp;fastPos=38&amp;oldAction=rechJuriJudi\">15 janvier 2019 n\u00b0 17-86461<\/a> la Chambre criminelle de la Cour de cassation confirme la responsabilit\u00e9 de l\u2019anesth\u00e9siste<\/p>\n<p style=\"text-align: justify;\"><em>\u00ab\u00a0qu\u2019<strong>en laissant sa patiente, toujours plac\u00e9e sous anesth\u00e9sie g\u00e9n\u00e9rale, sans surveillance par un personnel habilit\u00e9 au moment critique qu\u2019est par nature le changement d\u2019intervention, avec des mouvements de personnel, un changement de mat\u00e9riel induisant une baisse de vigilance, et une \u00e9ventuelle mobilisation, Mme Y&#8230; a commis une faute caract\u00e9ris\u00e9e qui a expos\u00e9 Mme B&#8230; \u00e0 un risque d\u2019une particuli\u00e8re gravit\u00e9, inh\u00e9rent \u00e0 toute anesth\u00e9sie g\u00e9n\u00e9rale, que tout m\u00e9decin anesth\u00e9siste ne peut ignorer de par sa formation<\/strong> ;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u00a0Attendu qu\u2019en l\u2019\u00e9tat de ces \u00e9nonciations, d\u2019o\u00f9 <strong>il r\u00e9sulte que les fautes caract\u00e9ris\u00e9es commises par Mme Y&#8230; ont contribu\u00e9 de fa\u00e7on certaine \u00e0 cr\u00e9er la situation ayant permis la r\u00e9alisation du dommage,<\/strong> nonobstant l\u2018imparfaite organisation des services qui ne peut \u00eatre consid\u00e9r\u00e9e comme la cause exclusive du dommage, les juges ne pouvant par ailleurs se prononcer sur les responsabilit\u00e9s \u00e9ventuelles d\u2019autres intervenants des agissements desquels ils n\u2019\u00e9taient pas saisis, <strong>la cour
