L\u2019agresseur est reconnu coupable devant le tribunal correctionnel de violences volontaires commises sur une personne charg\u00e9e d&rsquo;une mission de service public.<\/p>\n<p style=\"text-align: justify;\">Le <a href=\"https:\/\/www.fondsdegarantie.fr\/\">Fonds de garantie des victimes des actes de terrorisme et d&rsquo;autres infractions<\/a> (le FGTI), ayant indemnis\u00e9 l\u2019arbitre qui avait saisi une <a href=\"https:\/\/guillermou-avocats.fr\/lexique-juridique\/id-183-la-commission-d-indemnisation-des-victimes-d-infractions-civi\">commission d&rsquo;indemnisation des victimes d&rsquo;infractions,<\/a> assigne alors l&rsquo;association sportive et son assureur en remboursement des sommes vers\u00e9es \u00e0 la <a href=\"https:\/\/guillermou-avocats.fr\/droits-victime\">victime<\/a>.<\/p>\n<p style=\"text-align: justify;\">Le 23 f\u00e9vrier 2017, la Cour d\u2019appel de Paris, d\u00e9boute le FGTI\u00a0: si l\u2019agresseur a commis un manquement aux r\u00e8gles du jeu puisqu&rsquo;il a \u00e9t\u00e9 exclu du match par l&rsquo;arbitre, pour autant, ce manquement n&rsquo;est pas la cause directe du <a href=\"https:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">pr\u00e9judice<\/a> subi par ce dernier du fait des violences exerc\u00e9es ult\u00e9rieurement.<\/p>\n<p style=\"text-align: justify;\">En effet, la Cour consid\u00e8re que\u00a0<em>\u00ab\u00a0 les \u00a0actes commis par l\u2019agresseur sont constitutifs certes d&rsquo;une infraction p\u00e9nale <strong>mais non d&rsquo;un manquement aux r\u00e8gles du jeu d\u00e8s lors qu&rsquo;ils ont \u00e9t\u00e9 commis en dehors de toute activit\u00e9 sportive, le match \u00e9tant termin\u00e9 et l&rsquo;auteur des faits n&rsquo;\u00e9tant d&rsquo;ailleurs m\u00eame plus en tenue de joueur<\/strong> ; que, d\u00e8s lors, la faute de M. X&#8230; a \u00e9t\u00e9 commise en dehors du d\u00e9roul\u00e9 du match, m\u00eame si l&rsquo;arbitre victime \u00e9tait encore sur le terrain\u00a0\u00bb<\/em><\/p>\n<h3><a href=\"https:\/\/guillermou-avocats.fr\/id-3-victime-infraction-indemnisation\">Victime d&rsquo;agression<\/a><\/h3>\n<p style=\"text-align: justify;\">Par arr\u00eat du<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000037196721&amp;fastReqId=356765312&amp;fastPos=1\"> 5 juillet 2018 n\u00b0 17-19957<\/a>, la Cour de cassation\u00a0casse cette d\u00e9cision.<\/p>\n<p style=\"text-align: justify;\">Au visa de l&rsquo;article 1384, alin\u00e9a 1, devenu 1242, alin\u00e9a 1, du code civil qui dispose\u00a0:<\/p>\n<p style=\"text-align: justify;\"><em>\u00ab\u00a0Attendu que les associations sportives ayant pour mission d&rsquo;organiser, de diriger et de contr\u00f4ler l&rsquo;activit\u00e9 de leurs membres, sont responsables des dommages que ceux-ci causent \u00e0 cette occasion, d\u00e8s lors qu&rsquo;une faute caract\u00e9ris\u00e9e par une violation des r\u00e8gles du jeu est imputable \u00e0 un ou plusieurs de leurs membres, m\u00eame non identifi\u00e9s\u00a0\u00bb<\/em><\/p>\n<p style=\"text-align: justify;\">La Haute juridiction statue\u00a0:<\/p>\n<p style=\"text-align: justify;\"><em>\u00ab\u00a0Qu&rsquo;en statuant ainsi, alors que <strong>l&rsquo;agression d&rsquo;un arbitre commise dans une enceinte sportive par un joueur constitue, m\u00eame lorsqu&rsquo;elle se produit \u00e0 l&rsquo;issue de la rencontre, dont ce dernier a \u00e9t\u00e9 exclu, une infraction aux r\u00e8gles du jeu, en lien avec l&rsquo;activit\u00e9 sportive,<\/strong> la cour d&rsquo;appel a viol\u00e9 le texte susvis\u00e9\u00a0\u00bb<\/em>.<\/p>\n<p>Source : <a href=\"https:\/\/www.legifrance.gouv.fr\/\">L\u00e9gifrance<\/a><\/p>\n<p>Image: \u00a9Pixabay<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":2,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[93,27,30,34,86],"tags":[],"class_list":["post-5805","post","type-post","status-publish","format-standard","hentry","category-actualites","category-indemnisation","category-prejudice","category-responsabilite","category-victime-dagression"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.4 (Yoast SEO v27.4) -
