L\u00a0\u2018employeur est condamn\u00e9 \u00e0 r\u00e9parer le\u00a0<a href=\"http:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">pr\u00e9judice<\/a>\u00a0subi par son \u00e9pouse et ses deux enfants sur renvoi apr\u00e8s cassation. (Cour d\u2019Appel de \u00a0Metz du 29 septembre 2016, n\u00b015\/02996)<\/p>\n<p>L\u2019employeur et sa compagnie d\u2019assurance, se pourvoient en cassation. Ils contestent l\u2019indemnisation du pr\u00e9judice moral du plus jeune enfant \u00e0 hauteur de 25\u00a0000\u20ac et aujourd\u2019hui \u00e2g\u00e9 de 8 ans. Au moment de l\u2019<a href=\"http:\/\/guillermou-avocats.fr\/droits-victime\/\">accident<\/a>, ce dernier n\u2019\u00e9tait pas encore n\u00e9, la m\u00e8re \u00e9tait enceinte de 6 mois\u2026<\/p>\n<p>Ils appuient leur pourvoi sur l\u2019absence d\u2019\u00e9l\u00e9ment de nature \u00e0 \u00e9tablir la r\u00e9alit\u00e9 objective de la souffrance invoqu\u00e9e, soit l\u2019absence d\u2019\u00e9l\u00e9ment certain ainsi que sur le fait qu\u2019il n\u2019existe pas de lien de causalit\u00e9 entre le d\u00e9c\u00e8s accidentel d\u2019une personne et le pr\u00e9judice pr\u00e9tendument subi par son fils n\u00e9 apr\u00e8s son d\u00e9c\u00e8s , en violation de l\u2019article\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006070721&amp;idArticle=LEGIARTI000006437044\" target=\"_blank\" rel=\"noopener\">1382 du code civil (devenu 1240)<\/a>.<\/p>\n<p>La deuxi\u00e8me chambre civile de la Haute juridiction rejette le pourvoi\u00a0 par arr\u00eat du\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000036216902&amp;fastReqId=1088588962&amp;fastPos=1\" target=\"_blank\" rel=\"noopener\">14 d\u00e9cembre 2017 n\u00b016-26687:<\/a><\/p>\n<p><em>\u00ab\u00a0Mais attendu que,\u00a0<strong>d\u00e8s sa naissance, l\u2019enfant peut demander r\u00e9paration du pr\u00e9judice r\u00e9sultant du d\u00e9c\u00e8s accidentel de son p\u00e8re survenu alors qu\u2019il \u00e9tait con\u00e7u<\/strong>\u00a0; qu\u2019ayant estim\u00e9 que Z..
