Son \u00e9tat ne s\u2019am\u00e9liore pas et elle est transf\u00e9r\u00e9e dans un centre hospitalier o\u00f9 elle subit un drainage du rein avec pose d\u2019une sonde ur\u00e9trale. Elle y suit \u00e9galement une antibioth\u00e9rapie suite \u00e0 une infection urinaire.<\/p>\n<p>Au cours de l\u2019hospitalisation elle pr\u00e9sente une\u00a0<a href=\"https:\/\/eurekasante.vidal.fr\/maladies\/systeme-nerveux\/vertiges.html?pb=nevrite-vestibulaire\" target=\"_blank\" rel=\"noopener\">n\u00e9vrite vestibulaire\u00a0<\/a>\u00e0 l\u2019oreille gauche et demeure atteinte de vertiges, d\u2019hyperacousie et de migraines.<\/p>\n<p>Elle recherche la\u00a0<a href=\"http:\/\/guillermou-avocats.fr\/indemnisation-prejudice\/id-5-accident-medicaux-indemnisation\">responsabilit\u00e9<\/a>\u00a0de l\u2019\u00e9tablissement en soutenant que la n\u00e9vrite vestibulaire est la cons\u00e9quence d\u2019une<a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-147-infection-nosocomiale\">\u00a0infection nosocomiale<\/a>. Sa demande indemnitaire est rejet\u00e9e par le Tribunal administratif en 2014 puis par la Cour administrative d\u2019appel en 2015.<\/p>\n<p>Elle se pourvoit alors en cassation\u2026<\/p>\n<p>Le Conseil d\u2019\u00c9tat, par arr\u00eat du\u00a0<a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriAdmin.do?oldAction=rechJuriAdmin&amp;idTexte=CETATEXT000034900523\" target=\"_blank\" rel=\"noopener\">8 juin 2017 n\u00b0 394715<\/a>, d\u00e9cide d\u2019annuler la d\u00e9cision de la Cour administrative d\u2019appel. Si cette derni\u00e8re s\u2019\u00e9tait fond\u00e9e sur le\u00a0<a href=\"http:\/\/guillermou-avocats.fr\/expertise-medicale\">rapport d\u2019expertise<\/a>\u00a0qui affirmait que la n\u00e9vrite vestibulaire \u00e9tait li\u00e9e \u00e0 une infection virale\u00a0\u00ab\u00a0sans rapport avec les soins\u00a0\u00bb pour \u00e9carter le caract\u00e8re nosocomial de l\u2019infection, la juridiction supr\u00eame indique \u00a0qu\u2019\u00ab<em>\u00a0il lui appartenait seulement de v\u00e9rifier si celle-ci \u00e9tait pr\u00e9sente ou en incubation lors de l\u2019admission et, en cas de r\u00e9ponse n\u00e9gative, de reconna\u00eetre son caract\u00e8re nosocomial et de rechercher si l\u2019\u00e9tablissement apportait la preuve d\u2019une cause \u00e9trang\u00e8re ; qu\u2019en se pronon\u00e7ant comme elle l\u2019a fait, elle a commis une erreur de droit qui justifie, sans qu\u2019il soit besoin d\u2019examiner les autres<\/em>\u00a0\u00bb.<\/p>\n<p>Ainsi, les juges ne peuvent se limiter \u00e0 l\u2019interpr\u00e9tation faite d\u2019un rapport d\u2019expertise pour d\u00e9terminer si un patient souffre d\u2019une infection nosocomiale. Ils doivent rechercher si l\u2019infection \u00e9tait pr\u00e9sente ou non lors de l\u2019admission \u00e0 l&rsquo;h\u00f4pital\/en clinique. Si l&rsquo;infection n&rsquo;\u00e9tait pas pr\u00e9sente alors\u00a0le caract\u00e8re nosocomial de l\u2019infection peut \u00eatre reconnu et le centre hospitalier peut s\u2019exon\u00e9rer de sa responsabilit\u00e9 seulement en apportant la preuve d\u2019une cause \u00e9trang\u00e8re.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Infection nosocomiale Une septembre 2006, une patiente souffrant de coliques n\u00e9phr\u00e9tiques est hospitalis\u00e9e en clinique.
