La victime est\u00a0<a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/?motscles=consolidation\">consolid\u00e9e<\/a>\u00a0de ses l\u00e9sions le 20 octobre 2012 avec un taux d\u2019IPP de 100%.<\/p>\n<p style=\"text-align: justify;\">La Cour d\u2019appel de Lyon, par arr\u00eat du<a href=\"https:\/\/www.doctrine.fr\/d\/CA\/Lyon\/2017\/C5E563AD7B8D8D20811F0\">\u00a024 janvier 2017 n\u00b013\/07753<\/a>\u00a0reconna\u00eet l\u2019existence d\u2019un\u00a0<a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-212-prejudices-permanents-exceptionnels\"><strong>pr\u00e9judice permanent exceptionnel<\/strong>\u00a0<\/a>de\u00a0<strong>d\u00e9personnalisation avec perte identitaire\u00a0<\/strong>:<\/p>\n<h3 style=\"text-align: justify;\"><em>\u00ab (&#8230;) Sur le pr\u00e9judice exceptionnel :<\/em><\/h3>\n<p style=\"text-align: justify;\"><em>Le<a href=\"http:\/\/guillermou-avocats.fr\/traumatisme-cranien\">\u00a0traumatisme cr\u00e2nien<\/a>\u00a0dont a \u00e9t\u00e9 victime M. B. se trouve \u00e0 l&rsquo;origine d&rsquo;une profonde rupture d&rsquo;identit\u00e9, voire d&rsquo;une r\u00e9elle d\u00e9possession de sa personnalit\u00e9.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Son taux d&rsquo;IPP a \u00e9t\u00e9 fix\u00e9 \u00e0 100% par l&rsquo;expert qui rel\u00e8ve en outre &lsquo; un\u00a0<strong>pr\u00e9judice exceptionnel qui est pr\u00e9judice de d\u00e9personnalisation avec une perte identitaire<\/strong>\u00a0car il est observ\u00e9 quelques \u00e9veils relationnels plus importants en pr\u00e9sence de sa famille et de personnes connues&rsquo;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Ce pr\u00e9judice d\u00e9coulant de la nature particuli\u00e8re et de la gravit\u00e9 de ses s\u00e9quelles justifie le versement de la somme demand\u00e9 de 20 000 \u20ac.\u00a0\u00bb<\/em><\/p>\n<h3 style=\"text-align: justify;\">Indemnisation \u00e0 hauteur de 20\u00a0000\u20ac<\/h3>\n<p style=\"text-align: justify;\">Le poste de pr\u00e9judice autonome dit\u00a0 \u00ab\u00a0identitaire\u00a0\u00bb\u00a0ou de \u00ab\u00a0d\u00e9personnalisation\u00a0\u00bb a \u00e9t\u00e9 cr\u00e9\u00e9 par\u00a0<strong>Ma\u00eetre Emeric Guillermou<\/strong>\u00a0qui s\u2019\u00e9vertue \u00e0 le faire reconna\u00eetre chez les personnes souffrant de traumatismes cr\u00e2niens depuis plusieurs ann\u00e9es.
