L\u2019<a href=\"http:\/\/guillermou-avocats.fr\/droits-victime\/\">accident<\/a>\u00a0survient \u00a0\u00e0 hauteur du tracteur.<\/p>\n<p>Le cyclomotoriste est projet\u00e9\u00a0 \u00e0 terre puis tombe dans le foss\u00e9. Compte tenu de l\u2019importance du choc, il ne garde aucun souvenir des causes lui ayant fait perdre le contr\u00f4le de son v\u00e9hicule.<\/p>\n<p>La victime assigne le d\u00e9partement (le tracteur appartenait au Conseil g\u00e9n\u00e9ral) et son assureur en <a href=\"http:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">r\u00e9paration de ses pr\u00e9judices<\/a>.<\/p>\n<p>L\u2019arr\u00eat de la Cour d\u2019appel de Poitiers du 17 f\u00e9vrier 2016 la d\u00e9boute de sa demande d\u2019indemnisation\u00a0: la victime\u00a0doit d\u00e9montrer que le v\u00e9hicule, avec lequel il n\u2019y a eu aucun contact, a eu un <strong>comportement perturbateur<\/strong>.<\/p>\n<p>La victime de l\u2019<a href=\"http:\/\/guillermou-avocats.fr\/indemnisation-prejudice\/id-1-accident-route-indemnisation\">accident de la route<\/a> se pourvoit en cassation et reproche \u00e0 l\u2019arr\u00eat d\u2019avoir dit que le tracteur n\u2019\u00e9tait pas impliqu\u00e9 au sens de l\u2019article 1er de la <a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=LEGITEXT000006068902&amp;dateTexte=20100114\">loi du 5 juillet 1985<\/a> et de l\u2019avoir d\u00e9bout\u00e9 de ses demandes.<\/p>\n<p>Par arr\u00eat de la 2\u00e8me Chambre civile du <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000034141900&amp;fastReqId=1576849940&amp;fastPos=1\">2 mars 2017 n\u00b016-15.562<\/a>, la Haute juridiction statue en faveur de la victime car elle casse cette d\u00e9cision.<\/p>\n<p>La notion d\u2019implication d\u2019un v\u00e9hicule donne lieu \u00e0 de nombreuses interpr\u00e9tations jurisprudentielles, parfois contradictoires, \u00a0car elle n\u2019est pas d\u00e9finie par la loi.<\/p>\n<p>L\u2019esprit de la<strong> loi n\u00b0 85-677 du 5 juillet 1985 tendant \u00e0 l&rsquo;am\u00e9lioration de la situation des victimes d&rsquo;accidents de la circulation et \u00e0 l&rsquo;acc\u00e9l\u00e9ration des proc\u00e9dures d&rsquo;indemnisation<\/strong>\u00a0est \u00a0pourtant d\u2019\u00e9viter toute discussion sur la causalit\u00e9.<\/p>\n<p>Selon l\u2019article 1\u00a0:<\/p>\n<p><em>\u00abLes dispositions du pr\u00e9sent chapitre s&rsquo;appliquent, m\u00eame lorsqu&rsquo;elles sont transport\u00e9es en vertu d&rsquo;un contrat, aux victimes d&rsquo;un accident de la circulation dans lequel est impliqu\u00e9<\/em><em>\u00a0un v\u00e9hicule terrestre \u00e0 moteur ainsi que ses remorques ou semi-remorques, \u00e0 l&rsquo;exception des chemins de fer et des tramways circulant sur des voies qui leur sont propres.\u00a0\u00bb<\/em><\/p>\n<p>Monsieur Robert Badinter, \u00e0 l\u2019origine de cette loi, avait expliqu\u00e9 devant les parlementaires :<\/p>\n<p><em>\u00ab S\u2019agissant du terme <strong>impliqu\u00e9<\/strong>, il est volontairement tr\u00e8s large. C\u2019est le fait qu\u2019un v\u00e9hicule terrestre \u00e0 moteur soit intervenu, \u00e0 quelque titre que ce soit, qui d\u00e9termine l\u2019application des r\u00e8gles contenues dans le texte (&#8230;). <strong>On ne devrait donc pas avoir \u00e0 discuter du r\u00f4le causal ou non, actif ou passif, du v\u00e9hicule pour d\u00e9terminer son existence<\/strong>. \u00bb<\/em><\/p>\n<p>Cette d\u00e9cision respecte l\u2019esprit de la loi, favorable \u00e0 l\u2019indemnisation des victimes.<\/p>\n<p>Elle est \u00e0 rapprocher d\u2019une autre d\u00e9cision de la 2eme chambre civile de la Cour de cassation du <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000030117128\">15 janvier 2015 (n\u00b013-27.448)<\/a> qui reconnait \u00e9galement l\u2019implication d\u2019un v\u00e9hicule dans un accident\u00a0 en l\u2019absence de contact entre les v\u00e9hicules:<\/p>\n<p>\u00ab<em>\u00a0Attendu que pour d\u00e9bouter les consorts X&#8230; et la soci\u00e9t\u00e9 Z de leurs demandes, l\u2019arr\u00eat \u00e9nonce que la seule pr\u00e9sence du v\u00e9hicule conduit par M. Y&#8230;, en l\u2019absence de contact et de fait perturbateur de la circulation dont il serait \u00e0 l\u2019origine, ne permet pas de caract\u00e9riser son implication dans l\u2019accident ;<\/em><\/p>\n<p><em>Qu\u2019en statuant ainsi, la cour d\u2019appel, qui a subordonn\u00e9 l\u2019implication du v\u00e9hicule de M.
