alt=\"\" width=\"534\" height=\"412\" align=\"left\" \/><\/p>\n<h2>Accident de la circulation<\/h2>\n<p style=\"text-align: justify;\">La victime d\u2019un <a href=\"http:\/\/guillermou-avocats.fr\/indemnisation-prejudice\/id-1-accident-route-indemnisation\">accident de la circulation<\/a> assigne la compagnie d\u2019\u2019assurance du responsable du dommage en <a href=\"http:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">indemnisation de ses pr\u00e9judices<\/a>.<\/p>\n<p style=\"text-align: justify;\">Par arr\u00eat du 2 juillet 2015, la \u00a0Cour d\u2019appel de Versailles\u00a0soustrait du poste de pr\u00e9judice d\u2019<a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-196-assistance-par-tierce-personne\">assistance par tierce personne<\/a>\u00a0<a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F10009\">l\u2019allocation personnalis\u00e9e d\u2019autonomie <\/a>d\u00e9j\u00e0 vers\u00e9e au motif qu\u2019elle est par nature d\u00e9ductible, ayant pour objet d\u2019indemniser la perte d\u2019autonomie.<\/p>\n<p style=\"text-align: justify;\">\u00a0La Haute juridiction, par arr\u00eat du <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000033297300\">20 octobre 2016 n\u00b015-17507<\/a> d\u00e9cide, au visa des articles <a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexteArticle.do?idArticle=LEGIARTI000006839622&amp;cidTexte=JORFTEXT000000693454\">29<\/a> et <a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexteArticle.do;jsessionid=C43384DE1286AA2ACE06AE1EDE8E10E8.tpdila16v_2?idArticle=LEGIARTI000006839658&amp;cidTexte=LEGITEXT000006068902&amp;dateTexte=20100114\">33<\/a> de la<a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=LEGITEXT000006068902&amp;dateTexte=20100114\">\u00a0loi du 5 juillet 1985\u00a0<\/a>:<\/p>\n<p><em>\u00ab\u00a0Qu\u2019en statuant ainsi, alors que cette allocation, vers\u00e9e par le conseil d\u00e9partemental et non mentionn\u00e9e par l\u2019article 29 de la loi du 5 juillet 1985, ne donne pas lieu \u00e0 un recours subrogatoire contre la personne tenue \u00e0 r\u00e9paration, la cour d\u2019appel a viol\u00e9 les textes susvis\u00e9s\u00a0<\/em>\u00bb<\/p>\n<h3 style=\"text-align: justify;\">L&rsquo;allocation personnalis\u00e9e d&rsquo;autonomie ne s&rsquo;impute pas sur\u00a0l&rsquo;indemnisation\u00a0de la victime<\/h3>\n<p style=\"text-align: justify;\">\u00a0Tout comme la Prestation de compensation du handicap, l\u2019allocation personnalis\u00e9e pour l\u2019autonomie n\u2019est pas mentionn\u00e9e \u00e0 l\u2019article 29 de la loi du 5 juillet 1985 selon lequel <strong>seules doivent \u00eatre imput\u00e9es sur l\u2019indemnit\u00e9 r\u00e9parant l\u2019atteinte \u00e0 l\u2019int\u00e9grit\u00e9 physique de la victime les prestations vers\u00e9es par des tiers payeurs qui ouvrent droit, au profit de ceux-ci, \u00e0 un recours subrogatoire contre la personne tenue \u00e0 r\u00e9paration<\/strong> .<\/p>\n<p style=\"text-align: justify;\">Le versement de ces aides financi\u00e8res\u00a0destin\u00e9es \u00e0 compenser le handicap n\u2019a pas \u00e0 \u00eatre d\u00e9duit de \u00a0l\u2019indemnisation qui r\u00e9pare le pr\u00e9judice de la <a href=\"http:\/\/guillermou-avocats.fr\/droits-victime\/\">victime<\/a>.<\/p>\n<p style=\"text-align: justify;\">image:\u00a0\u00a9pixabay<\/p>\n<\/div><div
