Demander l\u2019aggravation devant la Cour d\u2019appel<\/h2>\n

Le 25 janvier 2008, un accident de la route<\/strong> est provoqu\u00e9 par un v\u00e9hicule qui heurte une motocyclette. La victime demande la r\u00e9paration de ses pr\u00e9judices<\/strong> aupr\u00e8s du conducteur responsable de l\u2019accident et de sa compagnie d\u2019assurance.<\/p>\n

Suite \u00e0 l\u2019accident\u00a0qui a provoqu\u00e9\u00a0une fracture ouverte de l’extr\u00e9mit\u00e9 inf\u00e9rieure de son tibia droit, la mise en place de mat\u00e9riel d’ost\u00e9osynth\u00e8se est n\u00e9cessaire.<\/p>\n

Le Tribunal de grande instance de Toulouse dans son jugement du 30 janvier 2011 octroie une indemnisation de son pr\u00e9judice corporel \u00e0 la victime.<\/p>\n

Mais le 8 octobre 2012, lors du retrait de ce mat\u00e9riel, cette derni\u00e8re contracte une infection \u00e0 staphylocoque dor\u00e9 dont elle conserve\u00a0\u00ab\u00a0des s\u00e9quelles consistant en une raideur importante de la cheville associ\u00e9e \u00e0 une boiterie antalgique, des s\u00e9quelles neurologiques et (\u2026) un contexte anxio-d\u00e9pressif.\u00a0\u00bb. Dans l\u2019impossibilit\u00e9 de travailler, elle augmente les heures de travail de sa salari\u00e9e et embauche une personne en CDD. Puis souffrant d\u2019une fatigue accrue et ne pouvant maintenir une station debout prolong\u00e9e, elle c\u00e8de son fonds de commerce de buraliste. Un expert, mandat\u00e9 par sa compagnie d\u2019assurance, constate l\u2019aggravation de son \u00e9tat de sant\u00e9 dans son rapport.<\/p>\n

Expertise m\u00e9dicale<\/h3>\n

La victime demande une nouvelle expertise m\u00e9dicale<\/a> afin de faire constater cette aggravation<\/a> et d\u2019en obtenir une indemnisation en appel.<\/p>\n

L\u2019arr\u00eat de la Cour d\u2019appel de Toulouse en date du 13 mai 2014 consid\u00e8re que l\u2019op\u00e9ration d\u2019expertise diligent\u00e9e par la compagnie d\u2019assurance de la victime \u00a0n\u2019est pas contradictoire car la compagnie d\u2019assurance du responsable de l\u2019accident n\u2019a pas \u00e9t\u00e9 convi\u00e9e \u00e0 y participer\u00a0: elle n\u2019est donc pas opposable.<\/p>\n

La Cour d\u2019appel rejette la demande de nouvelle expertise judiciaire ainsi que la demande de majoration des dommages-int\u00e9r\u00eats en r\u00e9paration du pr\u00e9judice r\u00e9sultant de l\u2019aggravation\u00a0:<\/p>\n

\u00ab\u00a0en raison de l’effet d\u00e9volutif de l’appel, la cour n’est saisie que de l’\u00e9valuation du pr\u00e9judice faite par le premier juge et non de l’aggravation all\u00e9gu\u00e9e et du pr\u00e9judice li\u00e9 \u00e0 l’ablation du mat\u00e9riel d’ost\u00e9osynth\u00e8se, qui constitue une nouvelle demande, non examin\u00e9e par le tribunal, et partant, irrecevable.<\/p>\n

Dans ces conditions, il ne sera pas fait droit \u00e0 la demande d’expertise judiciaire et la cour statuera au vu du rapport d’expertise du docteur de B. du 9 juillet 2010 qui repose sur un examen complet de la victime et permet d’\u00e9valuer compl\u00e8tement son pr\u00e9judice corporel<\/a>.\u00a0\u00bb<\/p>\n

La Cour d\u2019appel ne prendra donc en consid\u00e9ration que le rapport d\u2019expertise m\u00e9dicale initial (avant l\u2019aggravation).<\/p>\n

Si d\u2019anciennes jurisprudences refusaient toute nouvelle \u00e9valuation pour aggravation du pr\u00e9judice (civ 2eme 12 octobre 1972), il est aujourd\u2019hui possible de faire une nouvelle demande pour aggravation en 1\u00e8re instance.<\/p>\n

En l\u2019esp\u00e8ce, la \u00a0Cour de cassation, dans un arr\u00eat\u00a0 du 2 juillet 2015 (n\u00b014-22170)<\/a> casse et annule la \u00a0d\u00e9cision de la cour d\u2019appel\u00a0: \u00ab\u00a0 la demande d\u2019indemnisation du pr\u00e9judice major\u00e9 en cause d\u2019appel tendait aux m\u00eames fins que celle soumise aux premiers juges, la cour d\u2019appel a viol\u00e9 le texte susvis\u00e9.\u00a0\u00bb (Article 565 du code de proc\u00e9dure civile).<\/p>\n

Cette d\u00e9cision permet donc d\u2019ajouter la demande d\u2019indemnisation de l\u2019aggravation du dommage directement devant la Cour d\u2019appel.<\/p>\n

Le demandeur \u00e0 l\u2019instance a ainsi le choix: il peut terminer sa proc\u00e9dure d\u2019indemnisation initiale et d\u00e9clencher une nouvelle proc\u00e9dure qui concerne uniquement l\u2019aggravation ou bien demander une nouvelle expertise pour faire \u00e9valuer l\u2019aggravation, \u00e0 l\u2019int\u00e9rieur d\u2019une seule et m\u00eame proc\u00e9dure, directement en appel.<\/p>\n<\/div>
