{"id":3799,"date":"2015-11-02T17:12:59","date_gmt":"2015-11-02T16:12:59","guid":{"rendered":"https:\/\/guillermou-avocats.fr\/portfolio-items\/indemnisation-du-prejudice-psychique\/"},"modified":"2018-01-18T17:37:01","modified_gmt":"2018-01-18T16:37:01","slug":"id-81-indemnisation-du-prejudice-psychique","status":"publish","type":"post","link":"https:\/\/guillermou-avocats.fr\/fr\/actualites\/id-81-indemnisation-du-prejudice-psychique","title":{"rendered":"Indemnisation du pr\u00e9judice psychique"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\"  style='background-color: rgba(255,255,255,0);background-position: center center;background-repeat: no-repeat;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;'><div class=\"fusion-builder-row fusion-row \"><div  class=\"fusion-layout-column fusion_builder_column fusion_builder_column_1_1  fusion-one-full fusion-column-first fusion-column-last bigFontSize 1_1\"  style='margin-top:0px;margin-bottom:0px;'>\n\t\t\t\t\t<div class=\"fusion-column-wrapper\" style=\"background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;\"  data-bg-url=\"\">\n\t\t\t\t\t\t<div class=\"fusion-text\"><h2>Assistance par une tierce personne<\/h2>\n<p style=\"text-align: justify;\">La Cour d\u2019appel de Rouen, dans un arr\u00eat de 2013, avait refus\u00e9 d\u2019indemniser le poste de <a title=\"pr\u00e9judice d\u2019assistance par une tierce personne\" href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-196-assistance-par-tierce-personne\" target=\"_blank\" rel=\"noopener\">pr\u00e9judice d\u2019assistance par une tierce personne<\/a> avant <a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-131-consolidation\">consolidation<\/a> d\u2019une victime pour laquelle elle avait pourtant \u00ab\u00a0constat\u00e9 l\u2019existence d\u2019une g\u00eane totale dans les actes de la vie courante pour la p\u00e9riode d\u2019incapacit\u00e9 totale de travail retenue par les experts et une d\u00e9t\u00e9rioration majeure de l\u2019\u00e9tat de sant\u00e9 de la <strong>victime<\/strong> ainsi que l\u2019existence de troubles psychiques consistant en des reviviscences post-traumatiques de l\u2019angoisse de mort imminente avec d\u00e9compensations d\u00e9pressives cons\u00e9cutives\u00a0\u00bb \u00ab\u00a0aux motifs que la circonstance que des proches, mus par leur propre inqui\u00e9tude devant l\u2019\u00e9tat notamment moral de la victime, se fussent relay\u00e9s \u00e0 son chevet ne suffisait pas \u00e0 d\u00e9montrer la r\u00e9alit\u00e9 d\u2019un <strong>besoin d\u2019assistance par une tierce personne<\/strong> ; que comme la partie civile n\u2019entreprenait pas autrement de d\u00e9montrer le bien-fond\u00e9 de ses pr\u00e9tentions \u00e0 cet \u00e9gard, celles-ci ne pouvaient en cons\u00e9quence qu\u2019\u00eatre rejet\u00e9es\u00a0\u00bb.<\/p>\n<h3>Demande d\u2019indemnit\u00e9 pour tierce personne<\/h3>\n<p>La Cour de cassation, dans un arr\u00eat de la chambre criminelle du <a href=\"http:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000029508954\">23 septembre 2014 n\u00b0 13-85053<\/a>, d\u00e9cide, au vu de l\u2019<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006438819&amp;cidTexte=LEGITEXT000006070721\">article 1382 du code civil<\/a>, de casser et annuler en ses seules dispositions ayant rejet\u00e9 la demande d\u2019indemnit\u00e9 pour tierce personne avant consolidation l\u2019arr\u00eat susvis\u00e9. Elle rappelle clairement\u00a0 que \u00ab\u00a0<strong>le montant de l\u2019indemnit\u00e9 allou\u00e9e au titre de l\u2019assistance d\u2019une tierce personne ne saurait \u00eatre r\u00e9duit en cas d\u2019assistance d\u2019un membre de la famille ni subordonn\u00e9 \u00e0 la production de justificatifs des d\u00e9penses effectives<\/strong> ; \u00a0(\u2026) qu\u2019en se d\u00e9terminant ainsi, alors que la partie civile a sollicit\u00e9 une indemnisation au titre de l\u2019assistance d\u2019une tierce personne dont elle a eu besoin pendant la p\u00e9riode correspondant \u00e0 l\u2019incapacit\u00e9 totale de travail retenue par les experts, pendant laquelle ils ont relev\u00e9 une g\u00eane totale dans les actes de la vie courante, la cour d\u2019appel n\u2019a pas justifi\u00e9 sa d\u00e9cision\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">La Haute juridiction rappelle ainsi que le principe de la <a href=\"http:\/\/guillermou-avocats.fr\/indemnisation-prejudice\">r\u00e9paration int\u00e9grale<\/a>, ind\u00e9pendamment de l\u2019origine du dommage, comprend une indemnisation <strong>des pr\u00e9judices physiques et psychologiques (aide humaine temporaire)<\/strong>\u00a0: lorsqu\u2019ils sont constat\u00e9s par un expert, ils doivent \u00eatre pris en compte.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":2,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[93],"tags":[],"class_list":["post-3799","post","type-post","status-publish","format-standard","hentry","category-actualites"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.4 (Yoast SEO v27.4) -
