Il assigne le responsable et sa compagnie d\u2019assurance en indemnisation de ses pr\u00e9judices.<\/p>\n<p style=\"text-align: justify;\">La Cour d\u2019appel de Poitiers, dans un arr\u00eat du 9 octobre 2013, statue sur l\u2019indemnisation de plusieurs postes de <strong>pr\u00e9judice<\/strong> dont les<a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/?motscles=v%C3%A9hicule+adapt%C3%A9\"> frais de v\u00e9hicule adapt\u00e9<\/a> dont elle d\u00e9cide de faire r\u00e9server l\u2019indemnisation. Elle consid\u00e8re qu\u2019\u00a0\u00ab\u00a0une indemnisation au titre de la tierce personne 24 heures sur 24, et une indemnisation au titre de l\u2019am\u00e9nagement d\u2019un v\u00e9hicule pour sa conduite, sont peu compatibles. Que si \u00ab\u00a0l\u2019intim\u00e9 est en \u00e9tat de conduire un v\u00e9hicule, m\u00eame adapt\u00e9 \u00e0 son handicap, c\u2019est qu\u2019il ne n\u00e9cessite pas la pr\u00e9sence d\u2019une <strong>tierce personne<\/strong> en permanence et que \u00ab\u00a0l\u2019expertise judiciaire est peu explicite sur le point de l\u2019aptitude \u00e0 la conduite automobile, puisqu\u2019il est simplement indiqu\u00e9 en page 14 (consultation du docteur B&#8230; en date du 12 juin 2009) : \u00ab\u00a0 A toujours une tierce personne la nuit et le jour. Pas pr\u00eat et pas demandeur d\u2019essayer de conduire un v\u00e9hicule \u00bb\u00a0\u00bb.C\u2019est pourquoi la Cour \u00ab\u00a0r\u00e9serve le poste de pr\u00e9judice relatif \u00e0 l\u2019am\u00e9nagement d\u2019un v\u00e9hicule\u00a0\u00bb.<\/p>\n<h3 style=\"text-align: justify;\">Acc\u00e8s direct en fauteuil roulant au v\u00e9hicule et r\u00e9alisation d&rsquo;un point d&rsquo;ancrage pour le fauteuil<\/h3>\n<p style=\"text-align: justify;\">L\u2019arr\u00eat de la Cour de cassation du 15 janvier 2015 (n\u00b013-27761, 13-28050, 13-28211, 14-12600, 14-13017) casse ce moyen de la d\u00e9cision de la Cour d\u2019appel\u00a0.Sur le fondement de\u00a0<a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006410097&amp;cidTexte=LEGITEXT000006070716\">l\u2019article 4 du code de proc\u00e9dure civile,<\/a> elle d\u00e9clare\u00a0:\u00a0\u00ab\u00a0 Qu\u2019en statuant ainsi, alors que, dans ses conclusions d\u2019appel, M. X&#8230; r\u00e9clamait la prise en charge des frais li\u00e9s \u00e0 l\u2019acquisition et \u00e0 l\u2019am\u00e9nagement TPMR (Transport de Personne \u00e0 Mobilit\u00e9 R\u00e9duite\u00a0) d\u2019<strong>un v\u00e9hicule permettant son transport dans des conditions optimales de confort et de s\u00e9curit\u00e9 avec acc\u00e8s direct \u00e0 bord en fauteuil roulant et r\u00e9alisation d\u2019un point d\u2019ancrage pour le fauteuil<\/strong>, la cour d\u2019appel a m\u00e9connu les termes du litige et viol\u00e9 le texte susvis\u00e9\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">Ainsi la Cour de cassation rappelle, conform\u00e9ment \u00e0 la <a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-103-nomenclature-dite-dintilhac-\">Nomenclature dite \u00ab\u00a0Dintilhac<\/a> \u00bb, texte de r\u00e9f\u00e9rence en mati\u00e8re d\u2019indemnisation du <a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-148-dommage-corporel\">dommage corporel<\/a>, que les frais d\u2019adaptation du v\u00e9hicule couvrent v\u00e9ritablement tous les am\u00e9nagements n\u00e9cessaires \u00e0 l\u2019acc\u00e8s et \u00e0 l\u2019usage du v\u00e9hicule par la victime et non son aptitude \u00e0 le conduire.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":2,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[93],"tags":[],"class_list":["post-3798","post","type-post","status-publish","format-standard","hentry","category-actualites"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.4 (Yoast SEO v27.5) -
