Le motard percute l\u2019arri\u00e8re droit du v\u00e9hicule et tombe dans le coma: il est victime d\u2019un <a href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-140-traumatisme-cranien\">traumatisme cr\u00e2nien<\/a> grave. Il est plac\u00e9 sous mesure de protection judiciaire.<\/p>\n<p style=\"text-align: justify;\"><strong>Une proc\u00e9dure \u00e0 rebondissements<\/strong><\/p>\n<p style=\"text-align: justify;\">Par jugement du 6 mai 2008, \u00a0le Tribunal de Grande instance de Senlis reconnait les droits \u00e0 indemnisation de la victime et de ses proches pour l\u2019int\u00e9gralit\u00e9 des pr\u00e9judices r\u00e9sultants de l\u2019accident de la circulation de 2002 et d\u00e9signe un expert m\u00e9dical afin de les \u00e9valuer. Son rapport est d\u00e9pos\u00e9 le 20 d\u00e9cembre 2008. Un arr\u00eat de la Cour d\u2019appel d\u2019Amiens du 10 d\u00e9cembre 2009 confirme ce jugement et condamne la compagnie d\u2019assurance au versement d\u2019une provision. Un jugement du 12 avril 2011 octroie une indemnisation de la victime sur la base de ce rapport.<\/p>\n<p style=\"text-align: justify;\">Mais la compagnie d\u2019assurance\u00a0 fait appel de cette d\u00e9cision et sollicite la suspension de\u00a0 l\u2019ex\u00e9cution provisoire du versement de l\u2019indemnisation.<\/p>\n<p style=\"text-align: justify;\">Par ordonnance du Premier Pr\u00e9sident de la Cour d\u2019appel d\u2019Amiens, la compagnie est d\u00e9bout\u00e9e de toutes ses demandes. L\u2019affaire se poursuit donc au fond et le 11 d\u00e9cembre 2012 la Cour d\u2019appel d\u2019Amiens confirme d\u2019une part certains postes de pr\u00e9judices et d\u2019autre part r\u00e9ouvre les d\u00e9bats sur la question de l\u2019\u00e9valuation du besoin en aide humaine.<\/p>\n<h3 style=\"text-align: justify;\">Indemnisation pour un besoin en aide humaine 24h\/24h<\/h3>\n<p style=\"text-align: justify;\">L\u2019expertise a lieu en ao\u00fbt 2013 et confirme le besoin en aide humaine de la victime \u00e0 hauteur de 24H\/24H.<\/p>\n<p style=\"text-align: justify;\">Par un arr\u00eat<a href=\"upload\/Actualites\/Cour_dappel_Amiens_Chambre_civile_1_20_NOVEMBRE_2014.DOC\"> n\u00b011\/01842 du 20 novembre 2014<\/a>, la Cour d\u2019appel d\u2019Amiens s\u2019appuie sur le rapport d\u2019expertise pour reconna\u00eetre une indemnisation au titre de ce poste de pr\u00e9judice d\u2019un besoin en aide humaine 24H\/24H.<\/p>\n<p><strong>Une belle victoire de Proxima<\/strong><\/p>\n<p style=\"text-align: justify;\">Cet arr\u00eat de la Cour d\u2019appel d\u2019Amiens condamne \u00e9galement l\u2019assureur qui n\u2019avait pas respect\u00e9 son obligation de pr\u00e9senter une offre pr\u00e9cise d\u2019indemnisation \u00e0 titre provisionnel ou d\u00e9finitif (obligatoire dans le contexte d\u2019un accident de la circulation en vertu de l<a title=\"Article L211-9\" href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006073984&amp;idArticle=LEGIARTI000006795446&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener\">\u2019article L211-9 du code des assurances<\/a>) au titre de l\u2019article L211-13\u00a0du code des assurances \u00e0 verser les int\u00e9r\u00eats major\u00e9s soit un total de 2\u00a0834\u00a0004,70 \u20ac \u00e0 ce titre et \u00e0 compter du 7 juillet 2005 jusqu\u2019\u00e0 la date dudit arr\u00eat.<\/p>\n<p style=\"text-align: justify;\">Il faut noter que dans ce dossier, les pr\u00e9judices ont \u00e9t\u00e9 \u00e9valu\u00e9s, outre les int\u00e9r\u00eats, \u00a0\u00e0 la somme de<strong> 8\u00a0184\u00a0433,70 \u20ac<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Les proc\u00e9dures d\u2019indemnisation sont souvent tr\u00e8s longues pour obtenir la juste r\u00e9paration de son pr\u00e9judice.
