{"id":3762,"date":"2015-04-29T17:12:51","date_gmt":"2015-04-29T15:12:51","guid":{"rendered":"https:\/\/guillermou-avocats.fr\/portfolio-items\/scolarisation-denfant-en-situation-de-handicap\/"},"modified":"2018-01-18T18:22:15","modified_gmt":"2018-01-18T17:22:15","slug":"id-31-scolarisation-d-enfant-en-situation-de-handicap","status":"publish","type":"post","link":"https:\/\/guillermou-avocats.fr\/fr\/actualites\/id-31-scolarisation-d-enfant-en-situation-de-handicap","title":{"rendered":"Scolarisation d&rsquo;enfant en situation de handicap"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\"  style='background-color: rgba(255,255,255,0);background-position: center center;background-repeat: no-repeat;padding-top:0px;padding-right:0px;padding-bottom:0px;padding-left:0px;'><div class=\"fusion-builder-row fusion-row \"><div  class=\"fusion-layout-column fusion_builder_column fusion_builder_column_1_1  fusion-one-full fusion-column-first fusion-column-last bigFontSize 1_1\"  style='margin-top:0px;margin-bottom:0px;'>\n\t\t\t\t\t<div class=\"fusion-column-wrapper\" style=\"background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;\"  data-bg-url=\"\">\n\t\t\t\t\t\t<div class=\"fusion-text\"><p>Choix entre scolarisation et r\u00e9\u00e9ducation, le Tribunal Administratif de Poitiers a tranch\u00e9&#8230;<\/p>\n<p style=\"text-align: justify;\">Le 2 avril 2015, l&rsquo;Etat a \u00e9t\u00e9 condamn\u00e9 \u00e0 verser plus de 6000 euros d&rsquo;indemnit\u00e9s aux parents d&rsquo;une enfant de 12 ans, handicap\u00e9e moteur, pour n&rsquo;avoir pas r\u00e9pondu \u00e0 son obligation d&rsquo;organiser une offre de soins.Selon le jugement: \u00ab\u00a0la carence de l&rsquo;ARS (Agence R\u00e9gionale de Sant\u00e9) en mati\u00e8re d&rsquo;accueil des enfants handicap\u00e9s est constitutive d&rsquo;une faute de nature \u00e0 engager la responsabilit\u00e9\u00a0de l&rsquo;Etat\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">En l&rsquo;esp\u00e8ce, l&rsquo;ARS n&rsquo;avait pas r\u00e9pondu \u00e0 la demande d&rsquo;indemnisation des soins par les parents pour pallier \u00e0 la mise en place du Service d&rsquo;\u00e9ducation sp\u00e9cialis\u00e9 et de soins \u00e0 domicile (Sessad),\u00a0ce qui a motiv\u00e9 leur d\u00e9marche en faveur d&rsquo;une proc\u00e9dure.En effet, faute de place en Sessad pour jeunes d\u00e9ficients moteurs, lieu rassemblant tous les dispositifs de soins n\u00e9cessaires, la jeune fille avait d\u00fb choisir entre poursuivre une scolarit\u00e9 classique en perdant la prise en charge de ses soins ou int\u00e9grer un institut m\u00e9dico-\u00e9ducatif.<br \/>\nLes parents, soucieux de pr\u00e9server l&rsquo;\u00e9panouissement de leur fille, avaient d\u00e9cid\u00e9 de maintenir sa scolarit\u00e9 en milieu \u00ab\u00a0classique\u00a0\u00bb,organisant eux-m\u00eame les soins dispens\u00e9s, ses transports et en assumant leurs co\u00fbts.<br \/>\nMalgr\u00e9 ce d\u00e9nouement heureux, nous constatons que le droit d&rsquo;acc\u00e8s \u00e0 l&rsquo;\u00e9ducation n&rsquo;est toujours pas respect\u00e9 faute de structures adapt\u00e9es suffisantes, faisant \u00e9tat du non respect de la Convention Internationale relative aux Droits des Personnes Handicap\u00e9es (CIDPH) sign\u00e9e par la France en 2007, article 24 \u00a7 2. suivre le lien\u00a0<span style=\"color: #000080; font-size: 12pt;\"><a href=\"http:\/\/www.un.org\/french\/disabilities\/default.asp?id=1413\">Convention relative aux droits des personnes handicap\u00e9es<\/a><\/span><\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div>\n\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":2,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[93],"tags":[],"class_list":["post-3762","post","type-post","status-publish","format-standard","hentry","category-actualites"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.4 (Yoast SEO v27.6) -
