Un coll\u00e8gue a mis en route le tapis roulant de la chaufferie alors que sa jambe gauche \u00e9tait dessous\u00a0: elle a \u00e9t\u00e9 entra\u00een\u00e9e dans la cha\u00eene d\u2019\u00e9vacuation des cendres puis \u00e9cras\u00e9e et il a d\u00fb se faire amputer le jour m\u00eame.<\/p>\n<p style=\"text-align: justify;\">Dans ce contexte d\u2019accident du travail o\u00f9 la faute inexcusable de l\u2019employeur a \u00e9t\u00e9 reconnue,\u00a0 la victime per\u00e7oit les prestations pr\u00e9vues par le <strong>Code de la S\u00e9curit\u00e9 sociale<\/strong> en vertu de <strong>l\u2019article L452-3<\/strong> qui inclut les souffrances physiques et morales, le pr\u00e9judice esth\u00e9tique, le <a title=\"pr\u00e9judice d\u2019agr\u00e9ment\" href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-123-prejudice-d-agrement\" target=\"_blank\" rel=\"noopener\">pr\u00e9judice d\u2019agr\u00e9ment<\/a> et la perte de chance de promotion professionnelle. Il peut \u00e9galement lui \u00eatre allou\u00e9 d\u2019autres indemnit\u00e9s, depuis une d\u00e9cision du <strong>Conseil Constitutionnel<\/strong> qui a rendu le <strong>18 juin 2010<\/strong>, dans le cadre d\u2019une question prioritaire de constitutionnalit\u00e9 (QPC), une r\u00e9serve d\u2019interpr\u00e9tation sur cet article ouvrant la voie \u00e0 \u00ab\u00a0la r\u00e9paration de l\u2019ensemble des dommages non couverts par le livre IV du code de la s\u00e9curit\u00e9 sociale\u00a0\u00bb. <strong>Ce sont aux juridictions de v\u00e9rifier au cas par cas si les pr\u00e9judices ont d\u00e9j\u00e0 \u00e9t\u00e9 r\u00e9par\u00e9s.<\/strong><\/p>\n<h2 style=\"text-align: justify;\">Indemnisation des \u00ab\u00a0frais divers\u00a0\u00bb de jardinage<\/h2>\n<p style=\"text-align: justify;\">En l\u2019esp\u00e8ce, la victime sollicite une indemnit\u00e9 au titre du poste de la <a title=\"tierce personne\" href=\"http:\/\/guillermou-avocats.fr\/lexique-juridique\/id-2-allocation-compensatrice-pour-tierce-personne-acpt-\" target=\"_blank\" rel=\"noopener\">tierce personne<\/a> afin de couvrir des frais d\u2019entretien d\u2019un terrain arbor\u00e9 de 4000 m2 qui entoure son domicile. Mais la cour d\u2019appel d\u2019Angers dans un arr\u00eat du 4 f\u00e9vrier 2014 n\u00b012\/00877, s\u2019appuie sur le rapport d\u2019expertise qui lui reconnait\u00a0 \u00ab\u00a0la possibilit\u00e9 de tondre seul la pelouse au moyen d\u2019un tracteur-tondeuse\u00a0mais pas celle d\u2019\u00abassurer les travaux de taille\u00a0 des arbres et arbustes, d\u2019entretien des haies et des massifs et pr\u00e9parer le bois\u00a0\u00bbElle rejette sa demande d\u2019 indemnit\u00e9 \u00e9valu\u00e9e \u00e0 88\u00a0161,31 euros (capitalisation viag\u00e8re , 130 heures par an) au motif que \u00ab\u00a0le besoin d\u2019assistance par une tierce personne apr\u00e8s consolidation est indemnis\u00e9 par le livre IV du code de la s\u00e9curit\u00e9 sociale et \u00ab\u00a0qu\u2019il ne peut obtenir sur ce fondement l\u2019indemnisation des frais li\u00e9s \u00e0 la n\u00e9cessit\u00e9 de faire entretenir en partie son jardin par un tiers\u00a0\u00bb.Elle lui alloue par contre une <strong>indemnit\u00e9 de 7176 euros<\/strong> (16 heures par an)au poste de \u00ab\u00a0frais divers\u00a0\u00bb aux fins de couvrir le co\u00fbt des actes qu\u2019il ne peut accomplir seul.<\/p>\n<p>Il se pourvoit en cassation, o\u00f9 il pr\u00e9cise que la Cour n\u2019a pas examin\u00e9 si \u00ab\u00a0lesdits travaux relevaient des actes ordinaires de la vie courante, seuls pris en charge par les prestations l\u00e9gale au titre du livre IV de la s\u00e9curit\u00e9 sociale. Mais la Cour de cassation, le 9 juillet 2015, dans<a title=\"Frais divers\" href=\"http:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?idTexte=JURITEXT000030875553\"> son arr\u00eat n\u00b014-15.309<\/a> rejette sa demande au motif que la Cour d\u2019appel \u00ab\u00a0n\u2019avait pas \u00e0 proc\u00e9der \u00e0 une recherche inop\u00e9rante\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">Cette d\u00e9cision, si elle ne donne pas enti\u00e8re satisfaction au demandeur, a tout de m\u00eame le m\u00e9rite d\u2019ouvrir les possibilit\u00e9s d\u2019indemnisation dans le cadre d\u2019un accident du travail et de faute inexcusable de l\u2019employeur qui \u00e9taient, avant la QPC de 2010, tr\u00e8s restreintes .La jurisprudence devrait \u00e9tablir des postes indemnisables suppl\u00e9mentaires, non couverts par le livre IV du code de la s\u00e9curit\u00e9 sociale, qu\u2019il incombera aux avocats\u00a0 de d\u00e9fendre.
