{"id":1246,"date":"2017-05-03T16:36:35","date_gmt":"2017-05-03T14:36:35","guid":{"rendered":"https:\/\/guillermou-avocats.fr\/?page_id=1246"},"modified":"2020-04-14T15:45:13","modified_gmt":"2020-04-14T13:45:13","slug":"honoraires","status":"publish","type":"page","link":"https:\/\/guillermou-avocats.fr\/fr\/cabinet\/honoraires","title":{"rendered":"Les honoraires"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box fusion-blend-mode bigFontSize nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\"  style='background-color: rgba(255,255,255,0.5);background-position: left top;background-repeat: no-repeat;padding-top:0px;padding-right:0px;padding-bottom:50px;padding-left:0px;border-top-width:0px;border-bottom-width:0px;border-color:#eae9e9;border-top-style:solid;border-bottom-style:solid;'><div class=\"fusion-builder-row fusion-row \"><div  class=\"fusion-layout-column fusion_builder_column fusion_builder_column_1_1  fusion-one-full fusion-column-first fusion-column-last fusion-column-no-min-height 1_1\"  style='margin-top:0px;margin-bottom:0px;'>\n\t\t\t\t\t<div class=\"fusion-column-wrapper\" style=\"padding: 0px 0px 0px 0px;background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;\"  data-bg-url=\"\">\n\t\t\t\t\t\t<div class=\"fusion-text\"><h1 class=\"titre-page\" style=\"text-align: center;\">Les honoraires<\/h1>\n<div id=\"preview\">\n<div id=\"texte-interne\">\n<h2 style=\"text-align: center;\">Nos honoraires font l&rsquo;objet d&rsquo;une convention librement n\u00e9goci\u00e9e avec nos clients.<\/h2>\n<p style=\"text-align: justify;\">Cette convention repose sur 3 principes:<\/p>\n<ol style=\"text-align: justify;\">\n<li>Nos clients ne font pas l&rsquo;avance de nos honoraires<\/li>\n<li>Notre facturation intervient au fur et \u00e0 mesure des r\u00e9sultats obtenus<\/li>\n<li>Nos honoraires comprennent une partie fixe et une partie li\u00e9e aux r\u00e9sultats, gage de notre engagement.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Si vous poss\u00e9dez un contrat de protection juridique, la compagnie d\u2019assurance peut prendre en charge une partie des honoraires en fonction des plafonds pr\u00e9vus au contrat.<\/p>\n<h3 style=\"text-align: justify;\">En dehors des honoraires de l\u2019Avocat, certains frais inh\u00e9rents \u00e0 la proc\u00e9dure sont \u00e0 pr\u00e9voir tels que\u00a0:<\/h3>\n<ul style=\"text-align: justify;\">\n<li><strong>Frais d\u2019huissier<\/strong> (assignation, signification, citation, d\u00e9nonce\u2026)\u00a0: entre 60 \u20ac et 70 \u20ac par partie \u00e0 laquelle sera d\u00e9livr\u00e9 l\u2019acte<\/li>\n<li>Consignation de frais d\u2019expertise\u00a0: si un expert est d\u00e9sign\u00e9 par le Tribunal dans le cadre d\u2019un dossier de dommage corporel, les frais de consignation peuvent \u00eatre compris entre 1 300 et 2 500 \u20ac par expertise avec la possibilit\u00e9 de consignation compl\u00e9mentaire ordonn\u00e9e par le Tribunal.<\/li>\n<li><strong>Frais<\/strong> <strong>de traduction<\/strong>\u00a0: si votre dossier contient des documents r\u00e9dig\u00e9s en langue \u00e9trang\u00e8re, il conviendra de proc\u00e9der \u00e0 une traduction par un traducteur asserment\u00e9. Les frais de traduction sont \u00e0 votre charge et leur \u00e9valuation peut \u00eatre faite au nombre de mots, au nombre de pages ou encore en fonction de la nature du document (document m\u00e9dical, document de justice\u2026)<\/li>\n<li><strong>R\u00e9mun\u00e9ration d\u2019un m\u00e9decin de recours<\/strong>\u00a0: dans le cadre d\u2019un dossier de dommage corporel il est important de pouvoir se faire assister, au moment de l\u2019expertise, par un m\u00e9decin de recours. Sa r\u00e9mun\u00e9ration peut \u00eatre comprise entre 1500 et 3000 \u20ac.<\/li>\n<li>Depuis la loi n\u00b02014-1654 du 29 d\u00e9cembre 2014 (Article 1635 Bis P du code g\u00e9n\u00e9ral des imp\u00f4ts) les justiciables qui font appel d\u2019une d\u00e9cision dans une proc\u00e9dure imposant l\u2019assistance d\u2019un avocat doivent verser un droit de 225 \u20ac par partie appelante.<\/li>\n<li>En cas de pourvoi en cassation\u00a0: il est n\u00e9cessaire de recourir \u00e0 un avocat inscrit sur la liste de la Cour de Cassation. Ses honoraires peuvent \u00eatre compris entre 4 000 et 5 000 \u20ac.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ces tarifs ne sont communiqu\u00e9s qu\u2019\u00e0 titre indicatif et ne lient en aucun cas le cabinet en cas de facture faisant \u00e9tat d\u2019un montant sup\u00e9rieur \u00e0 ceux indiqu\u00e9s.<\/p>\n<p style=\"text-align: justify;\"><strong>IMPORTANT<\/strong>\u00a0: les frais d\u2019huissiers, de m\u00e9decin de recours et de consignation de frais d\u2019expertise sont parfois pris en charge par votre protection juridique c\u2019est pourquoi il est important d\u2019effectuer votre d\u00e9claration de sinistre au plus t\u00f4t aupr\u00e8s de votre compagnie d\u2019assurance.<\/p>\n<p style=\"text-align: justify;\"><strong>N.B.<\/strong><\/p>\n<p style=\"text-align: justify;\">En cas de contestation d\u2019honoraires, vous pouvez adresser une r\u00e9clamation \u00e9crite au Cabinet par LRAR afin de r\u00e9soudre \u00e0 l\u2019amiable le litige directement avec votre avocat. En cas de d\u00e9saccord, l&rsquo;article Article <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000032224805&amp;cidTexte=LEGITEXT000006069565&amp;dateTexte=20190701\">L612-1 du code de la consommation,<\/a> permet de recourir <strong>gratuitement \u00e0 un m\u00e9diateur de la consommation<\/strong> en vue de la r\u00e9solution amiable d\u2019un litige qui l\u2019oppose \u00e0 un professionnel.
